You are not allowed to sell alcoholic beverages on Allegro.

You can sell alcohol accessories (such as beer coasters or empty bottles) and foods that have alcohol as one of the ingredients (such as pralines with alcohol filling).

On Allegro, you cannot sell gambling machines within the meaning of the Gambling Act (the text available only in Polish).

You can list collectible banknotes and copies (reproductions) of banknotes on Allegro, but only in appropriate categories. The product must have a description written according to certain standards.

In Collections and Art — Collections — Banknotes, you can list collectible banknotes issued with collectors and numismatists in mind. Such banknotes:

• were issued to commemorate important events or to honor extraordinary and authority figures and their role in history
• are legal tender, as you can use them according to the same regulations as banknotes in circulation.

Copies (reproductions) of banknotes are items that are not banknotes in circulation. For this reason, you cannot label them as collectible banknotes. You can list them in the subcategory created especially for them: Collections and Art — Collections — Banknotes — Copies and Facsimiles.

If you sell batteries and accumulators, make sure you comply with the Batteries and Accumulators Act of April 24, 2009. Your obligations as a retailer are described in Article 53 and the provisions regarding the deposit fee – in Article 54 and what follows.

Goods covered by the Act

• lead-acid automotive batteries
• lead-acid automotive accumulators
• lead-acid industrial batteries
• lead-acid industrial accumulators.

Your obligations under the Act

• You are required to accept the waste automotive and industrial lead-acid batteries or accumulators from the buyer.
• You must include the following information in a visible place in the offer description:
  • the conditions and procedures for returning waste batteries and accumulators, and the information about the possibility of having the deposit fee refunded (including the amount of the deposit fee)
  • the information about the collection points for waste batteries and accumulators provided by the manufacturer or distributor whose products you are selling.

You are not allowed to sell databases (including personal data and email lists) on Allegro. It is also prohibited to sell software which generates databases from websites.

You can offer emailing services to people who have agreed to receive advertising information.

In order to be able to sell in the Tickets category, you have to, among other things:

• have a business account
• obtain our consent and sign a separate agreement with us
• meet the following requirements:
  • conduct a business activity that involves the authorized sale of e-tickets
  • list at least 500 offers per month
  • provide after-sales customer service and handle complaints
  • use the software integrated with Allegro via RestAPI.

You cannot share your offers with this kind of assortment from allegro.pl on other marketplaces.

Selling tickets is possible only on allegro.pl.

You are not allowed to sell weapons and ammunition on Allegro.

This ban concerns in particular:

• firearms, including firearms for combat, hunting or sports, gas pistols, alarm and signal guns

This ban does not apply to alarm and signal guns with a caliber up to 6 mm, using short blank rimfire cartridges, or separate-loading firearms manufactured before 1885, or their replicas.

• pneumatic weapons

This ban does not apply to air guns with a projectile energy below 17J. In the description of the product, you are required to declare that the projectile energy does not exceed 17J.

• crossbows (including essential components such as prods and tillers)
• other products defined as weapons in the Weapons and Ammunition Act (for example, brass knuckles, nunchucks, concealed weapons with hidden blades).

The ban on sales applies also to:

• ready-made or processed essential elements for firearms and pneumatic weapons (firearm frame, action, barrel with chamber, lock, receiver, cylinder)
• essential ammunition elements (projectiles filled with explosives, chemical incapacitating agents, incendiary substances or other substances which are a threat to life or health, primers which trigger the burning of a propellant, and gunpowder)
• deactivated firearms, even if they are legal in other countries.

Pepper sprays and paralyzers

The sale of pepper sprays and paralyzers (electroshock weapons) is possible in the Pepper Sprays and Paralyzers categories. You may carry it out only if you are licensed to sell goods for military or police use, once you meet the relevant technical requirements and we verify your permits.

Required documents:

• full business documents and a valid CEIDG (Central Registration and Information on Business) document if you are a sole trader
• authorization to operate an outlet of equipment for military or police use (including electroshock weapons, pepper sprays) in PDF and a paper copy certified as authentic. To register an outlet of equipment for military or police use, attach your special business license. The rules to attain licenses are set out in the Act of June 22, 2001, on economic activity in the sphere of manufacturing of and trade in explosives, arms, ammunition and technology for military or police use (Journal of Laws of 2001, no. 67, item 679).
• EU certification. Only gases authorized for sale within the EU can be sold on Allegro.
• name, address and contact phone number of the physical outlet.

Ammunition

We allow for the sale of non-combat ammunition which is not filled with explosives, chemicals, incapacitating agents, incendiary substances or other substances which are a threat to life or health.

You need to declare that the ammunition is non-combat configured in the offer description.

Some products from the following subcategories need to have the Condition parameter — New:

• Paintwork Care Products
• Motorcycle Chemicals
• Washing and care
• Engine Oils
• Other
• General fluids
• Repair and protection supplies.

Check the list of subcategories in the Automotive category where you cannot list used products.

On Allegro, you cannot sell:

• cards and decoders owned by the digital TV operators mentioned above.
• devices owned by Orange Polska, for example, Livebox 1.1, Livebox 2.0, Livebox 3.0, FunBox, Sagemcom UHD86, Sagemcom UHD88, Sagemcom WHD80, Samsung SHD85, Alcatel-Lucent ONT I-010G-A.

If you are offering a decoder purchased from the operator, be sure to include the device serial number (in text form) in the offer description.

On Allegro you can sell terrestrial TV DVB-T2 decoders (tuners) provided they meet the requirements described in the Regulation of the Minister of Digital Affairs of October 7, 2019, on the technical and operational requirements for digital receivers.

The requirements that the DVB-T2 decoder must meet:

• the decoder (tuner) operates using the H.265/HEVC video standard, the MPEG-2 Audio Layer 2 audio standard and Dolby E-AC-3/Dolby Digital Plus
• a receiver that can be connected to the Internet must operate hybrid TV using the HbbTV standard in version 2.0.1. or newer.

If your terrestrial TV DVB-T2 decoder (tuner) meets the requirements determined in the regulation, include the information listed above in the offer description.

Video on demand

On Allegro, you cannot offer access to streaming services related to listening and watching content on demand online (including video on demand). This applies to any codes, passwords, tokens, keys or accounts to such services as:

• Netflix
• Showmax
• HBO GO
• Vodafone TV (UPC)
• Disney+
• Apple TV
• Google Play Movie
• Voyo VOD
• iVysílání (ČT)
• Kino iDnes
• Videotéka O2

Music streaming platforms

On Allegro, you cannot sell access to services related to music streaming platforms, such as Spotify or Tidal.

Official resale

If you run an official resale business and have signed a separate agreement with us, you can sell access to services listed above.

If you are an official reseller, but you have not concluded a separate agreement with us, contact us at legalne_kody@allegro.pl.

You are not allowed to sell any vehicle registration cards or history cards on Allegro without the vehicles for which they were issued. It is also prohibited to attach these documents to individual vehicle parts.

The ban does not apply to collector license plates.

It is prohibited to sell vehicles without their documents.

Account access

On Allegro, it is prohibited to sell access to accounts with computer, console and mobile games. These are accounts on such platforms as:

• Steam
• Epic Games Store
• GOG
• uPlay
• Origin
• Playstation Network
• Xbox Live.

Access to accounts with free-to-play games

On Allegro, you are allowed to sell accesses to accounts with free-to-play games, such as League of Legends, Fortnite czy World of Tanks. In this case, you offer a level reached in the game, a developed character, or other unique content.

You cannot sell access to accounts with access to paid games, even along with free-to-play games.

Game subscriptions

On Allegro, you cannot sell accounts with game subscriptions, such as PlayStation Plus, Xbox Live Gold or Xbox Game Pass.

Game keys

You are allowed to sell game keys on Allegro.

You can sell mushrooms on Allegro if you have a relevant certificate issued by a mycologist or mushroom expert. This does not apply to cultivated mushrooms and mushrooms available for sale in other EU countries. This is stipulated in the Ordinance of the Minister of Health.

If you list mushrooms (fresh, dried, or processed), you should include the declaration that they have the appropriate certificate in the offer description. Additionally, attach a scan of the certificate or a photo of the label with the information about the mushroom species, certificate number, and year of harvest.

For cultivated mushrooms and mushrooms available for sale in other EU countries, include a clear photo of the label.

You cannot share your offers with this kind of assortment from allegro.pl on other marketplaces.

You are not allowed to sell website addresses (links), FTP server addresses, and non-service information or instructions on Allegro.

It is also prohibited to offer:

• advice on bypassing rules and regulations that are applicable also outside Allegro
• advice on using online systems offering financial profits (for example, payments for displaying banners or receiving emails).

These restrictions do not apply to the sale of internet domains, hosting services, advertising or other services intended to provide information (such as tarot card readings, individual diet plans, and others).

You are not allowed to sell shares in companies, stocks, bonds, debts, participation units, insurance policies and products, or any other financial instrument offered as a form of investment or cash deposit on Allegro.

Exceptions to this are securities in a physical form, offered exclusively as collectibles. Securities can only be classed as collectibles when the ownership right confirmed on the document has expired and the value of the document lies solely in its age and uniqueness.

Cryptocurrencies

You are not allowed to sell so-called cryptocurrencies (such as bitcoin, litecoin, dogecoin, and others), as well as related services and products (for example: mining stocks, processing power, scripts). This prohibition does not apply to selling computer equipment.

Perfect Money

On Allegro, you cannot sell the Perfect Money payment processors, for example in the form of e-vouchers. These products violate the regulations of the Act of August 19, 2011, on payment services.

Perfect Money payment instruments are issued by a financial institution that is based outside the European Economic Area. This institution is not authorized to provide e-payment services, including issuing electronic payment instruments, in the EU territory.

You are not allowed to bank sell prepaid cards on Allegro.

The sale of registered prepaid phone cards is also prohibited. This restriction is based on the Act on anti-terrorism measures of June 10, 2016.

You can sell unregistered phone cards.

You cannot share your offers with this kind of assortment from allegro.pl on other marketplaces.

You are not allowed to sell mail order and direct sales catalogs, from which you can still order goods. Moreover, you cannot add these catalogs to other products.

Collectible catalogs – from which you cannot order the goods anymore – are an exception to this rule.

On Allegro, you cannot sell barcodes — GTINs and EAN codes. The GS1 organization is the only source of valid GTINs and EAN codes, and it does not sell licenses for those numbers on Allegro.

On Allegro, it is prohibited to sell:

• instant messaging apps accounts (including account numbers) (for example, GG, Skype, Jabber, ICQ)
• free email accounts
• social media accounts (such as Facebook or Twitter) and other accounts which are free to register and maintain (like Steam accounts which are empty or contain free games, or free accounts on chomikuj.pl)
• accounts or accesses (invitations) to torrent and adult/pornographic websites, including the currencies used on such websites. This ban applies to both paid and free websites.
• services related to free websites (for example, leaving likes, opinions or comments).

Assigning or sharing instant messaging apps accounts, free email accounts or other free web accounts may violate the service provider’s terms of use.

These rules do not apply to selling accounts in some online games.

You can sell solid fuel boilers (stoves) on Allegro only if they have an appropriate certificate (test certificate for solid fuel boilers), confirming the possibility of placing the solid fuel boiler (stove) on the market in accordance with European standard EN 303-5:2012.

If you want to sell a solid fuel boiler (stove), attach the certificate to the offer description. You can do it by attaching the PDF or a clear photo.

On Allegro, you are not allowed to sell discount (rebate) coupons which provide a discount or other benefit when purchasing goods or services outside Allegro. This applies not only to coupons in a material form – documents – but also to those in the form of a commitment.

What you can offer in the Coupons category

• vouchers and coupons, regardless of their value, which allow the use of services or purchase of products on Allegro
• other vouchers and coupons (their value must cover the full amount of the goods or services)
• competition vouchers (for example codes on packaging).

You can sell online courses on Allegro if you meet certain criteria and sign a separate agreement with us. In order to do so, contact us at kursy@allegro.pl.

You cannot share your offers with this kind of assortment from allegro.pl on other marketplaces.

On Allegro, it is absolutely prohibited to sell prescription medications.

However, it is possible to sell non-prescription medications (OTC medication). The Polish law allows the distance selling of OTC medication, subject to certain conditions specified in the Pharmaceutical Law Act of 2007. The detailed conditions for the distance selling of OTC medication are laid down in an Ordinance of the Minister of Health from 2008.

Non-prescription medication can only be listed by authorized sellers in the OTC Medication category.

You cannot share your offers with this kind of assortment from allegro.pl on other marketplaces.

You are not allowed to sell explosives on Allegro. This ban applies to, among other things, gunpowder, percussion caps and explosive pellets.

Pyrotechnic materials

Pyrotechnic materials may be sold in the Fireworks category only by sellers who hold the appropriate license, once the relevant requirements have been met and after Allegro has verified the permits and certificates. Pyrotechnic materials can be sold to adults only.

An entrepreneur may purchase and store explosives if:

• they are licensed to produce or trade in explosives
• the type of explosives purchased, stored or used for civilian purposes matches the type of explosives specified in the license
• they have storage facilities meeting the requirements laid down in the regulations issued pursuant to Article 24(2) and Article 33(2) of the Act of June 22, 2001, on economic activity in the sphere of manufacturing of and trade in explosives, arms, ammunition and technology for military or police use
• they employ people who meet the requirements for having access to explosives for civilian use.

Required documents:

• full business documents and a valid CEIDG (Central Registration and Information on Business) document, certified as being true to the original if you are a sole trader
• the license to carry out economic activity in the sphere of the manufacturing of and trading in explosives, arms, ammunition and technology for military or police use (Journal of Laws, no. 67, item 679, as amended) certified as being true to the original
• CE legalization documents certified as being true to the original.

All pyrotechnic materials must bear the CE marking – to confirm they are safe. In addition, their markings must indicate the relevant class, product name, locations where they can be used, directions for use, manufacturer’s details and quantity of pyrotechnic material.

Since some carriers will have their own policies and restrictions, it is important to note the appropriate form of shipment.

You cannot share your offers with this kind of assortment from allegro.pl on other marketplaces.

We allow selling music, video and software provided that it does not infringe the copyright or intellectual property rights of the respective authors.

Prohibited products include:

• copies of original publications
• publications issued without a license (for example, in other countries)
• unlicensed files (including those installed on a computer drive or memory card)
• disk images (for example, BIN/CUE, ISO, NRG, mdf/mds, img/ccd/sub)
• game saves.

The sale of original (licensed) publications is allowed.

When selling data and images (for example: BMP, GIF, JPEG, TIFF), audio (for example: FLAC, MP3, WMA, WAVE, MIDI) or video (for example: MP4, MPEG, AVI, ASF/WMV, MOV, RM), you must own the copyright for the creative works you sell.

You are not allowed to sell drugs, intoxicants, psychotropic substances or so-called drug substitutes on Allegro.

Prohibited products include:

• cannabis seeds and plant parts (for example, of cannabis indica)
• seeds and plant parts of salvia divinorum (known as sage of the diviners, seer’s sage)
• seeds and plant parts of Siberian motherwort (marihuanilla, little marijuana, honeyweed)
• amyl nitrate (poppers) under any trade name
• gamma-butyrolactone (GBL)
• 1,4-butanediol
• narcotic substances, for example, HHC, HHC-O, HHC-P, THCP and such.

For plants and substances with psychoactive properties, it is prohibited to suggest in the offer description that they can be used as an intoxicant or a psychotropic substance.

It is also prohibited to suggest in the offer description that a product can be used as a device facilitating the use of narcotic intoxicants or psychotropic substances.

If you list seedlings, trees, shrubs, plant bulbs, or seeds, we will require you only declare that they have a passport issued by an authorized entity in the offer description. Provide your customers with the passport. This way, you can carry out the Regulation of the European Parliament and the Council (EU) on protective measures against pests of plants.

For details, check the Regulation of the European Parliament and the Council (EU) of October 26, 2016, on protective measures against pests of plants.

On Allegro, you are not allowed to sell any software that infringes developers’ licenses. This ban also concerns software test versions – alpha, beta, and RC (Release Candidate) versions.

You cannot sell software with freeware, shareware, or abandonware licenses either ― even if the offer description states that the price applies to the media only and includes the cost of downloading the software from the internet.

If you sell software under GNU/GPL licenses, make sure your offer does not infringe these licenses. You can find the license content on the product packaging, on the developer’s website, or in the file that came with the software.

You cannot sell OEM software and used software (ESD) either.

You can sell new software (ESD) only if you have a business account and are authorized to do so. This also applies to software sold in boxes (BOX) containing both the durable medium and the software activation code. In order to get the authorization, contact us through the contact form and submit:

• the business document scans: extracts from the National Court Register (KRS) or the Central Register and Information on Economic Activity (CEIDG)
• the usernames of Allegro accounts from which you want to sell the software
• a statement or a certificate confirming your cooperation with the software producer or the authorized distributor in Poland.

You can sell used software on a CD or another durable medium only with an original packaging containing the activation code. You can sell it both from a business and a regular account.

You are not allowed to list and sell software or devices intended to violate laws and moral principles on Allegro.

Prohibited products include:

• software that contains viruses, so-called Trojan horses, or other harmful or destructive components
• devices (tools and software) that help infringe copyright or intellectual property rights
• software or hardware that facilitates spying on the activities of computer users
• software and hardware for removing locks or passwords from desktop computers and laptops, hard drives, storage media, car radios, anti-theft locks from mobile phones (for example, iCloud activation locks on the iPhone). It is also prohibited to trade in information, instructions or services related to the removal or establishment of such locks.
• software that allows email addresses to be harvested from websites or which is designed for mass email sending. According to Allegro policy, it is prohibited to send unsolicited emails to users. As a result, we do not allow the listing of software which can facilitate such activities.
• software that plays on behalf of gamers in online games (bots). It is also prohibited to sell licenses, scripts or any services relating to such software.

You can sell liquid fuels, such as petrol, diesel fuel, heating oil, liquefied petroleum gas (LPG) or biofuels on Allegro.

In order to obtain a permit to sell liquid fuels on Allegro, you need to:

• have a business account
• hold a liquid fuel sales licence applicable in Poland (OPC licence)
• conclude a separate agreement with Allegro.

If you want to sell in the Fuels category – contact us at sprzedazpaliw@allegro.pl. You can trade in fuels only within the borders of Poland.

On Allegro, you are not allowed to sell products containing gross pornographic content, in particular with the participation of people under the age of 18 or animals, or involving violence.

Permitted adult and pornographic products must be placed in the Erotica category.

You can list only two offers with a given product with the parameter New in one subcategory — regardless of the number of accounts you have. If you list multiple offers of the same product, we may terminate them.

What if you list a product set

If your offers make up a product set, we do not consider them duplicates.

What this rule stems from

We want buyers to be able to find products as effortlessly as possible. By limiting the number of identical products in one subcategory, we make it easier for buyers to find what they are looking for faster and more easily.

How we check if offers are duplicated

We consider:

• the product you linked the offer to
• parameters (including EAN)
• thumbnails.

We consider offers to be duplicated if they are listed by the same seller and with the same data in categories listed above ― even if they are listed from different accounts.

We may terminate the duplicated offers early. In such cases, we keep the offer that enjoys more of the buyers' attention, with consideration of the Smart! badge, offer promotion, Allegro Ads, the GREAT PRICE program participation, and the highest GMV (Gross Merchandise Value).

If we terminate your offers, we will let you know by email. You can filter such offers out in the My Assortment tab. If you log in to your Allegro account and cannot find the offer we terminated, clear cookies in your browser. We will refund you fees related to duplicated offers proportionally to the time they were visible on Allegro.

The buyer who wants to access a terminated offer will be redirected to your active offer with the same product.

On Allegro, you are not allowed to sell MA, BA, or PhD theses, high school graduation works, graded assignments, essays, and the like, due to doubts on ethical and legal grounds.

It is also prohibited to offer services related to the creation of such works, in particular those involving the collection of materials, writing or helping to write them.

If you sell explosives precursors, you need to comply with the Regulation of the European Parliament and of the Council (EU).

What the explosives precursors are

Explosives precursors are substances that may be used to illegally create explosives, which then can be utilized for purposes of criminal activity. Explosives precursors are, among others:

• substances stipulated in Annexes I and II of the Regulation and its amendments
• mixtures containing these substances.

How to sell explosives precursors

On Allegro, you are allowed to sell explosives precursors stipulated in Annex I to the Regulation if:

• you have a business account
• you list an offer as prescribed in the Allegro Terms & Conditions
• you verify the buyer.

You can also sell explosives precursors stipulated in Annex II to the Regulation from a regular account. However, you need to prepare offers as prescribed in the Allegro Terms & Conditions. Additionally, you are obliged to verify the buyer.

How to verify a buyer

Before you dispatch an order, you need to check whether the buyer is allowed to purchase explosives precursors. For this purpose, they need to submit the documents necessary to identify themselves to you. You can find templates of such documents in Annexes III and IV to the Regulation.

If any transaction appears suspicious to you, inform the relevant authorities, such as Krajowy Punkt Kontaktowy ds. Prekursorów materiałów wybuchowych (The National Point of Contact for explosives precursors).

How to prepare an offer complaint with the Terms & Conditions

In the offer, you must:

• inform that a listed product contains so-called explosives precursors
• present the list of substances contained in the product, including concentration and quantity of the explosives precursors.
• inform that the buyer must present a permit to purchase explosives precursors.

You can sell explosives precursors only in Poland.

You can list SUP products on Allegro. If you ship such products internationally, make sure you do not infringe the law of a given country by doing so. The sale of SUP products is banned in some EU countries ― for example, in Czechia.

On Allegro, you are not allowed to sell accounts being a part of partner and loyalty programs, nor the services related to these programs.

By partnership programs, we mean any marketing tools and services in which participants are remunerated for conducting specific activities aimed at increasing sales of a product. A loyalty program is any system of intentional, long-term marketing activities aimed at building and maintaining good contact with the customers the business considers the most attractive.

The regulations of partnership and loyalty programs often prohibit their participants from giving up accounts and distributing materials and services outside a certain area. Moreover, promoting goods and services on Allegro, when they are offered outside the service is against our Terms & Conditions. Therefore, such offers are prohibited at Allegro.

It is not allowed to sell non-authentic (counterfeit) products on Allegro.

It is also prohibited to sell products that in any way violate third party rights, including trademark rights, commercial rights, company branding rights and protected designation of origin.

Other prohibited products include those whose marking (like description on the packaging) may mislead customers about the essential features of the product – origin, quality, workmanship, and others.

If you would like to certify that the products you offer are authentic:

• include a declaration of authenticity in the description
• do not use materials (photos, descriptions) from the manufacturer’s website without their permission
• include your own images of the product in the offer description.

We ask manufacturers and brand owners participating in the Rights Protection Cooperation Program for support in establishing whether a product is authentic. See the list of companies and organizations we cooperate with.

You can sell such products on Allegro if:

• you have a license letting you run such an activity
• you sell them only to buyers who have obtained authorizations listed in article 61 of this Act (available only in Polish).

This applies to such products as:

• bulletproof vests
• helmets
• face shields, limb protectors and similar products.

Additional information

• If you offer such products, but they are not meant for military or police use (for example, a bulletproof vest without ballistic panels) — provide relevant information in the offer description. Additionally, create an offer title which will not mislead buyers.
• If you sell bulletproof vests with ballistic panels, provide the expiration date of the panels in the offer description.

You are not allowed to sell products which:

• promote fascist or other totalitarian state systems
• incite hatred on grounds of national, ethnic, racial or religious differences, or due to the absence of religious beliefs.

Example: contemporary mugs, keychains, lanyards, busts with a Nazi swastika, other Nazi symbols or images of war criminals.

You can sell the following products:

• products with artistic value
• products with educational value
• collectibles
• products with scientific value.

Example: authentic products from a specific period, contemporary copies of uniforms and uniform elements, scientific or collectors’ publications.

In order to list an offer in the Antennas and Amplifiers category, you must include the following in its description:

„Samodzielny montaż oraz używanie wzmacniaczy GSM/UMTS/LTE zwanych również repeaterami przez osoby nieuprawnione jest prawnie zabronione. Prawo do instalacji tego typu urządzeń posiadają wyłącznie operatorzy sieci komórkowych. Products in the E-Books and MP3 Audiobooks subcategories may only be sold by official distributors after meeting the relevant technical requirements and passing verification.

That applies only to eBooks and audiobooks that are sold separately — they are not an integral part of the publishing set. If you sell an eBook as an addition to another product — you can list such a set in the main product's category. For example: you list a textbook that comes with graphic materials in the form of an eBook. You will list it in the category that applies to the textbook.

If you want to start selling in those subcategories, contact us at ebooki@allegro.com. It will be possible if you meet the conditions below.

• You allow buyers to download the ebooks and mp3 audiobooks they buy in the My Shelf tab — you can do that by integrating with the API (we will send you instructions by email).
• The average monthly number of active offers in either subcategory on your account is at least:

• 1,000 — for the MP3 Audiobooks subcategory

or

• 10,000 — for the E-books subcategory.

This does not apply to sellers who offer only publications of their authorship or publications of which they are the publisher.

• You include in the offer description information about the post-purchase terms of use, for example, about the possibility of downloading eBooks and audiobooks in the My Shelf tab.
• You configure the offer so that the Returns tab contains information that it is impossible to withdraw from the agreement without providing a reason (according to the Allegro returns policy concerning digital content).

You can list banknote image reproductions if they meet the conditions determined by the National Bank of Poland.

One-sided banknote reproductions of the front or back page should:

• be at least 125% bigger or smaller than 75% of an authentic banknote size

  or

• have an opaque watermark:

  • WZÓR (design)

  • SPECIMEN

    or

  • REPRODUKCJA (reproduction) — written in Arial (or a similar font) in a contrasting color. The text must be placed diagonally, and have a length equal to at least 75% of reproduction length and height up to 15% of reproduction height.

Two-sided banknote reproductions should meet at least 2 of the following conditions:

• be at least 200% bigger or smaller than 50% of the authentic banknote, and the material must significantly differ from the paper the authentic banknotes are printed on
• have one corner cut off in a straight line

• have an opaque watermark:

  • WZÓR (design)

  • SPECIMEN

    or

  • REPRODUKCJA (reproduction) — written in Arial (or a similar font) in a contrasting color. The text must be placed diagonally, and have a length equal to at least 75% of reproduction length and height up to 15% of reproduction height.

Due to legal regulations, you are not allowed to sell fishing gear and equipment on Allegro.

It is prohibited to sell the following types of equipment:

• towed nets: seine nets, large fishing nets, pair trawls, dredges
• set nets: fixed gillnets, lam (splash) nets, trammel nets, box traps, fyke nets, a set of more than 2 fyke nets, crawfish traps, baskets, crawfish pots, fish-weirs, double fyke nets
• electric devices, including parts, used for catching fish with electricity
• other: drift nets, landing nets, trawling lines, heaving lines, bundles and other ice fishing gear
• fish pumps and eel traps.

• Hazardous chemicals

On Allegro, you cannot sell hazardous chemicals ― for example, cancerous or radioactive ones.

You cannot sell products that contain aluminum phosphide as an active substance.

Under the Polish law, selling and purchasing hazardous chemicals involves a number of restrictions. Such products are not publicly available. Storage and transport conditions are regulated by detailed guidelines. As distance selling of such products is risky, we do not allow you to list or sell them on Allegro.

• Substances or mixtures posing a threat to life and health

In the descriptions of offers with products of that kind (for example, household cleaning supplies, plant protection products, paints, solvents, etc.) we require the following information that are available on the product label:

• name, address, and phone number of the supplier (manufacturer or distributor)
• nominal quantity of the substance or mixture in the package
• product ID
• pictograms indicating the type of hazard (as a separate image or label visible in the image)
• warnings
• phrases indicating the type of hazard
• phrases indicating precautionary measures
• supplementary information specified in article 25 of the Regulation (EC) no 1272/2008 of the European Parliament and of the Council of 16 December 2008 on classification, labeling and packaging of substances and mixtures, amending and repealing Directives 67/548/EEC and 1999/45/EC, and amending Regulation (EC) No 1907/2006.

When you add the information listed above to the offer description and we translate the offer into other languages, foreign buyers will be provided with the comolete product information.

The product label should be available in the language of the country you ship it to.

Prepare for changes

From 2025, all labels or packaging of such substances will have to include a UFI code.

What is a UFI code

It is a unique 16-digit code identifying mixtures.

How to obtain a UFI code

You can generate it here. Next, report the UFI code to the appropriate state institution.

How to prepare an offer

Make sure the UFI code is visible on the label image or provide it in the offer description. This way, you assure your customers that the mixture you offer is approved for sale under the applicable regulations.

Legal basis

You can find the regulations regarding the use of UFI codes and labeling of mixtures in the Annex VIII of the Commission Regulation (EU).

Those are substances or preparations offered as food, cosmetic, and pharmaceutical products, or products intended for research purposes, that are often used for the above purposes but do not comply with food or pharmaceutical laws or contain substances that are not allowed. Those are, for example: yohimbine, ostarine, ligandrol, DMAA, modafinil, ipamorelin, and aniracetam.

You are not allowed to sell systems for numbers games (and so-called lottery systems), stock exchange investments, and betting services.

It is also prohibited to offer services related to providing help to place such bets.

This prohibition does not apply to official book publications with an ISBN number.

On Allegro, you cannot list a phone (e.g. telephone set, smartphone) that has been or may be blocked by the mobile operator. What is more, you must not stipulate in the offer that the seller is not responsible for such blockage.

In the case of a phone bought from a mobile operator on an installment plan, the offer has to indicate clearly that the seller owns the phone, and the operator will not block it.

On Allegro, you cannot sell human tissue including organs, body parts, bodily fluids and discharge. It is prohibited to sell, among other things, pubic hair, nails, bones, ova, blood, semen, and feces.

It is prohibited to sell:

• tobacco
• e-cigarettes, vaping bases or liquids (including those that do not contain nicotine)
• tobacco heaters and nicotine pouches
• spare refill containers and their parts
• cigarettescigars.

Herbal products for smoking

On Allegro, you can sell products like hemp cigarettes provided that there is a warning on the packaging informing about the health consequences of smoking, for example, Smoking this product damages your health.

The packaging should meet all the requirements of the Act of November 9, 1995, on Health Protection against the Consequences of Tobacco and Tobacco Products ― especially section 9(e).

You are not allowed to sell radio and telecommunication devices or other products which do not conform to the essential requirements of the Office of Electronic Communications.

This includes all the kinds of devices, such as radio equipment and telecommunications terminal equipment, listed in the register kept by the Office of Electronic Communications. Devices which do not conform to the essential requirements may cause electromagnetic interference which affects the functioning of other devices operating in the same environment. They also may not have the required immunity to electromagnetic interference.

The current list of these devices is available in the register maintained by the Office of Electronic Communications.

For health and hygiene reasons, some products should not be reused.

You can sell veterinary OTC medicinal products on Allegro if:

• you have a business account
• your business is entered in the registry of entities carrying out retail of OTC medication published on the Polish General Veterinary website (or in a similar registry of any other EU or partner country)
• you send us a request and we verify it successfully
• you list the offer with those products in the correct category — Non-prescription veterinary drugs.

On Allegro you can sell medical devices (for example, pulse oximeters or thermometers) which:

• have labels in Polish
• have a manual in Polish included
• are labeled with the CE marking and a four-digit code.

If you sell class I medical products (for example, cervical collars or wheelchairs) whose manufacturer carries out an assessment of conformity, you do not need to provide the four-digit code ― the CE marking is enough.

How to prepare the offer description

If medical devices you sell meet the requirements listed above, prepare a correct offer description. It should include:

• the completed Medical device parameter
• the CE mark with a four-digit number of a notified body (if it participated in the product conformity assessment process) ― in text form
• information about the label in Polish
• information about the user manual and user interface in Polish, and the EU declaration of conformity.

We may remove offers in which you do not provide the images or information listed above.

In vitro medical products, systems, and diagnostic medical devices

On Allegro, you cannot sell in-vitro diagnostic medical devices, systems, and procedure packs intended for professional use.

Professional use medical products are used by experienced professionals qualified for using them as intended.

This category includes the majority of tests for diagnosing SARS-CoV-2.

On Allegro you can sell:

• medical products for in-vitro diagnostics, designed for self-checks
• containers for samples taken from human body, as listed in Article 2(1)(39)(b) of the Act (available only in Polish)
• laboratory equipment for general use designed for in-vitro diagnostics as described in Article 2(1)(39)(c) of the Act (available only in Polish).

In the case of medical devices for self-control, it should be clearly indicated on the packaging (label) of the product, and in the instructions for use, that it is a product intended for self-control.

You are not allowed to sell the following products:

• gold bars and their copies
• gold coins
• silver bars and their copies.

Exceptions:

• Gold coins up to the year 1800 – you can list them on Allegro and Allegro Lokalnie.
• Scrap silver and gold – you can sell it on Allegro

• Collectible gold coins – you can list them on Allegro if you:

  • have entered into a separate agreement with Allegro under the Collector's Zone program, in the Collectible Gold Coins category
  • have declared your intention to sell products in this category and meet certain conditions.

• Products in the Investment Products category (except for the Scrap silver and gold subcategory) – you can list them on Allegro if you:

  • have entered into a separate agreement with Allegro under the Collector's Zone program
  • have declared your intention to sell products in this category and meet certain conditions.

In the Investment Products category, you can sell bars of gold and silver, but not their copies.

What the scrap is

These are objects that are no longer usable or metal in an unprocessed form (for example, jewelry fragments, broken cutlery, metal sheets, granules, powder, metal filings, elements of electrical components, electrodes removed from the devices they were used in, coins damaged so much that they have lost all monetary value, and so on).

Offers listed in the Live Animals category are only allowed as classified. If you are offering live animals on Allegro, you are required to provide humane transportation for them. It should also be possible for buyers to see the place where your animals are bred, and to pick them up in person. Include all the information about the animal’s documents and pedigree in the offer description.

If your classified ad concerns a dog or a cat, you must include the following information in its description:

• the name of the breeder
• the name of the kennel club
• a proof of the animal’s pedigree.

It is prohibited to sell living or dead specimens (including their parts and derived products) of the protected animal species. You can find the updated list of protected species in Annexes A-D to the Council Regulation (EC) No 338/97 of 9 December 1996.

It is also forbidden to list classifieds concerning animal adoption.

Cats and dogs

According to the amendment to the Animal Protection Act:

• only the breeding kennels and catteries registered in the national social organizations whose statutory purpose is activity related to the breeding of pedigree animals have the right to breed cats and dogs commercially
• cats and dogs can only be sold on the premises of a registered breeder
• selling cats and dogs other than through the breeder (non-pedigree) is forbidden – these animals can be only given away for free
• only registered catteries and breeding kennels may list classifieds related to breeding and mating of cats and dogs.

Invasive species of plants and animals

On Allegro, you cannot sell plants and animals of alien species that could threaten the native species or local habitats in the event of releasing them to the environment.

You can find a full list of invasive species in the Regulation (Journal of Laws of 2011, no. 210, item 1260).

Mole traps

You can list mole traps on Allegro. If you ship such products internationally, make sure you do not infringe the law of a given country by doing so. The sale of mole traps is banned in some EU countries ― for example, in Czechia. You cannot share your offers with this kind of assortment from allegro.pl on other marketplaces.

On Allegro, it is prohibited to sell codes, coupons, and vouchers in any form that enables exchanging them for:

• tickets for movie screenings in the cinemas
• services and products offered in the cinemas.

This ban does not apply to entities conducting official business activity in terms of resale, which entered into a separate agreement with Allegro.

You can sell them only to persons over 18 years old in the Energy drinks subcategory.

An energy drink contains a minimum of 150 mg of caffeine per 1 liter or any amount of taurine. This does not apply to products in which caffeine is a natural ingredient — for instance, coffee. You can sell beverages containing leas than 150 mg of caffeine per 1 liter as isotonic or functional beverages with no age restriction — in the Functional drinks subcategory.
