What obligations the GPSR imposes on you

What the GPSR is
The EU's General Product Safety Regulation (GPSR) took effect on December 13, 2024. The regulation will introduce changes that also apply to online sales conducted on platforms such as Allegro. Check what obligations regarding remote sales you will be required to fulfill under the new law.
The legal change will affect you if you list products in specific categories. If you list offers in categories excluded from the GPSR , you do not need to change anything.
If the product in your offer was placed on the market before December 13, 2024, you can select the Product introduced to the EU market before 13.12.2024 parameter. You can do so in a single offer or in multiple offers at once.
How to add the parameter in a single offer:
- Go to the listing form.
- In the Products in offer section, mark the declaration stating that the product in your offer was placed on the market before that date.
How to add the parameter in multiple offers:
- Go to the My Assortment tab.
- Select the offers for which you want to add the declaration in bulk.
- Click the Product option and add the declaration stating that the products from your offer were placed on the market before that date.
You can also do it through the Allegro API and a file.
In accordance with the new regulations, from December 13, 2024, you have to provide in your offers:
- manufacturer's details
- details of a person responsible for placing the product on the EU market — you need to provide them only if the manufacturer's registered office is outside the European Union
- safety information.
That obligation stems from the EU requirements. As Allegro, we are addressing those requirements and helping you run your business in accordance with EU law.
How you can complete the obligatory details
1. Producer's details:
- first and last name, registered trade name or registered trademark
- address
- email address and — optionally — contact number.
You can add manufacturers' details in the Producers data section of the Sales Settings tab.
How to complete the manufacturer's details in a single offer
Add the details in the Products in offer section of the listing form. You will do it separately for each product. If you sell a product set within one offer, you can select different manufacturers for the products.
How to complete the manufacturer's details in several offers at once
- Go to the My Assortment tab.
- Check the selected offers.
- In the bottom bulk editing bar, select Product, and then Manufacturer details.
- Select the correct Manufacturer details and click [save].
The manufacturer's details can be added to the offer: separately, in bulk, through the Allegro API , and through a file.
Within the Allegro Product Catalog, for selected products, we suggest the manufacturer's details that you can add to your offers. When you list or edit an offer, select the Brand parameter value. We will show you suggestions of the manufacturer's details based on that value. Once you select one of them, we will complete the offer with that manufacturer's details.
2. The details of the person responsible for introducing the product onto the European market — you need to provide them only if the manufacturer's registered office is outside the European Union:
- first and last name, registered trade name or registered trademark
- address
- email address.
You can add the details of the person responsible in the Persons responsible section of the Sales Settings tab.
Provide the details of a person responsible for introducing the product onto the European market following Article 16(1) of the GPSR or Article 4(1) of the EU regulation 2019/1020.
How to complete the details of the person responsible in a single offer
Add the details in the Products in offer section of the listing form. You will do it separately for each product. If you sell a product set within one offer, you can select different persons responsible for each product.
How to complete the details of the person responsible in several offers simultaneously
- Go to the My Assortment tab.
- Check the selected offers.
- In the bottom bulk editing bar, select Product, and then Person responsible.
- Select the correct Person responsible for the product in the EU and click [save].
You can complete the details of the person responsible also in bulk through the Allegro API and from a file.
3. Warnings and safety information — informing how to use the product in a safe way, for example:
- product's user manual — add attachments in the official language of the country where you sell your product. If you sell in all the Allegro marketplaces, the user manual should come in the Polish, Czech, Slovak, and Hungarian versions
- images of labels on the product's packaging
- note with warnings about the product.
You can attach those details in the PDF, JPG, PNG, or text formats.
How to complete the safety information separately
Add the details in the Products in offer section of the listing form. You will do it separately for each product. If you sell a product set within one offer, you can select different safety information for each product.
How to complete the safety information in several offers at once
- Go to the My Assortment tab.
- Check the selected offers.
- In the bottom bulk editing bar, select Product and then Safety information.
- Complete the safety information and click [save].
You can complete the safety information in bulk also through the Allegro API and through a file.
To look up offers in which you do not provide information about the manufacturer, person responsible, or safety information, use the incomplete product details filter in the My Assortment tab.
Parameters identifying a product we will mark as obligatory in connection with the GPSR are, for example:
- brand
- manufacturer code
- GTIN (EAN)
- product number
- series
- type
- kind.
You can find the detailed list of parameters and categories in which we will mark them as obligatory in this file.
You can look up offers in the My Assortment tab using a Brand-type parameter. Depending on the category you sell in, that parameter may be called:
- Brand
- Publishing house
- Label
- Manufacturer.
Use that filter to easily look up products of a single brand and manage them in bulk. It will allow you to quickly complete the required information.
How to declare that the products you sell are compliant with the regulation
We have made available a form where you will declare that you sell products compliant with the GPSR. When you submit it, we will add that information in the About Seller section on the product page.
You will submit the declaration once you click [upload declaration].

Manufacturer — every natural or legal person who manufactures a product or orders the design or creation of a product and sells it under their name or trademark.
Distributor — every natural or legal person who introduces the product onto the market but is not the manufacturer or importer.
Person responsible — the person responsible for the conformity of a product with the EU regulations. As per the DSA (Digital Services Act), they are a manufacturer, authorized representative, importer, distributor, order fulfillment service provider, or any other natural or legal person subject to obligations that concern the manufacturing of products, introducing products onto the market, or commissioning them under the applicable EU law.
Following the GPSR requirements, if there is an obligation to provide safety information for a product (such as certificates or warnings), the seller must make it available to consumers. If that information is included in the user manual, you can attach it. Safety information should be clear, easy to understand, and available in the language of the country where the product is sold.
We have made it possible for sellers to provide the information required by the regulation and made sure that buyers see it in offers. However, we cannot take over the responsibilities that the new regulation imposes on you as a seller.
You, as an entrepreneur, are the controller of the personal data you provide as the details of the persons responsible. As a seller, you are obliged to process personal data by the law. When you sell on Allegro, you entrust us with processing such personal data in accordance with the Terms & Conditions. Buyers and sellers on Allegro need to provide valid and truthful details, including personal data.
What is the Condition parameter?
It refers to the state of the listed item. Parameter values may vary, depending on the category in which you place the item. The most common values for the Condition parameter are: new and used.
While listing an offer, you have to select a Condition parameter. It concerns the state of the item you are listing, and informs a buyer about its condition.
Available values for the Condition parameter
Below you can find simplified definitions. Check the full definitions in the Terms & Conditions.
New — this value describes a brand new product that has not been used, opened, repackaged, or damaged. It has to be in its original packaging and have the manufacturer's designation intact — for example, a hangtag in clothing. The product cannot have any traces of use.
New with defects — this value describes a brand new product that has not been used, opened, or repackaged but has been damaged. However, this defect does not affect its functioning. A product described as New with defects should be in its original packaging and have the manufacturer's designation intact — for example, a hangtag in clothing.
Used — this value describes a product that has been used. The product may have traces of use, but it is fully functional and works as intended. A product described as Used may lack some parts or accessories — for example, screws (in furniture).
Retreaded — this value is used to describe only the condition of tires. It applies to tires that have been regenerated — they have a new tread layer. Such tires are not damaged nor older than 5 years. They must pass the pressure test.
Certified refurbished — this value describes a product with minimal or no traces of use. The product has been professionally checked, cleaned, and refurbished by the manufacturer or distributor and complies with the requirements described in the specifications. The product is in a new or replacement packaging and has original or new accessories.
Seller refurbished, Remanufactured, or Refurbished — each value describes a product that has been restored to a usable condition. The product has been checked, cleaned , repaired, and is fully functional. It has minimal or no traces of use. The product may (but does not have to) be sold in the original packaging. It has original or new accessories.
Ex-display — this value describes a product that may be missing its original or protective packaging. It can also be in a replacement or original packaging, which is not sealed. An Ex-display product may have slight traces of use, but it is fully functional and works as intended. It has original or new accessories.
Open packaging, Repackaged, New without tags — each value describes a product that may be missing original or protective packaging. It can also be in a replacement or original packaging, which is not sealed. The product is in good condition and has original accessories. It is not worn out, and potential traces of use are related only to repackaging.
After returns — this value describes a product that may not have its original or protective packaging. It can also be in a replacement or original packaging, which is not sealed. The product is in good condition and has original accessories. It is not worn out, and potential traces of use are related to a short use or repackaging.
For parts or Not working — this value describes a product or its element that may not work as intended and is not fully functional. This value applies to products with defects, requiring repairs, or missing essential parts.
Incomplete, Incomplete set, Incomplete kit — each value describes a product with minimal or no traces of use. It may be missing its original packaging or elements included in the original kit.
Salvaged or Disassembled — this value describes a product that has been disassembled and has minimal traces of use related to assembly, transport, or preparation for sale. It may be missing its original or protective packaging. It can also be in a replacement or original packaging, which is not sealed.
Needs refurbishment — this value describes a vintage product with apparent traces of use or aging of material that can be removed or repaired. The product's appearance does not impact its functioning. A product with this value does not have to be in its original packaging.
Does not need refurbishment — this value describes a vintage product that does not have apparent traces of use or aging of the material. Such a product has not been refurbished, nor does it need to be — its appearance does not differ noticeably from the original condition. The product is functional and can be used as intended. It does not have to be in its original packaging.
The entrepreneur’s obligation to inform the consumer
If you run a business account on Allegro as an entrepreneur, you are obliged to keep consumers informed. This results from various laws and directives.
If you have a business account and sell goods and services as an entrepreneur, you have special rights and obligations. In the case of agreements concluded online, the buyer is the disadvantaged party ― they do not have the opportunity to see an item before purchase ― so the legal provisions protecting them are more restrictive than in the case of a regular sale.

What you have to inform consumers about
One of the most important rights of the buyer is the right to be informed. Before concluding an agreement ― which is equal to making a purchase ― they should get detailed knowledge about an object, subject and conditions of the transaction. Such information can be provided in relevant tabs: Warranty, Complaints, Returns, About the seller. As an entrepreneur, while presenting the offer at the latest, you should inform the consumer about:
- main features of the consideration, including the service object and the method of communicating with a consumer
- their identification data, including information about the business, the body registering business activity, and the business registration number
- the address of the business seat, the email address, (if available) phone or fax numbers the consumer can call to contact the entrepreneur fast and efficiently
- the address where the consumer can file a complaint ― if it is different than the address mentioned above
- the total price or compensation, including tax, and when the form of service provided does not allow determining it ― a method of calculating tax; also, transport costs, postage, and other fees ― and when it is impossible to determine those costs, you should inform about the obligation of paying them; in the event of concluding an agreement for an indefinite period or a subscription agreement, you are obliged to inform the consumer about the total price or compensation, including all installments for the billing period, and where the contract provides for a fixed rate ― also the total monthly payments
- costs of distance communication to conclude an agreement ― if these costs are higher than the regular costs of using a given communication method
- the payment deadline and method
- the deadline and method of fulfilling the consideration by the entrepreneur and their complaint consideration procedure
- a method and time limit for exercising the right to withdraw from an agreement under Article 27, and the sample withdrawal from agreement form set out in the Attachment 2 to the Act
- returns cost to be incurred by the consumer if they withdraw from the agreement. With regard to agreements concluded remotely, the cost of returning the items if, due to their nature, the items cannot be returned by post
- the consumer’s obligation to repay the justified costs incurred by the entrepreneur, as stipulated in Article 35 if the consumer withdraws from the agreement after filing a claim, as stipulated in Article 15(3) and Article 21(2)
- no right to withdraw from an agreement under Article 38 or under circumstances when the consumer loses the right to withdraw from the agreement
- the entrepreneur’s obligation to provide defect-free goods
- the existence and content of warranty, and post-sale services and methods of providing them
- the code of good practice, stipulated in Article 2(5) of the Act of August 23, 2007, on combating unfair commercial practices, and the way of learning about it
- the duration of an agreement or the method and conditions of its termination ― if an agreement is concluded indefinitely or is to be extended automatically
- the minimum duration of the consumer's obligations under the agreement
- the amount of any deposit or other financial guarantee and the method of paying it, to be provided by the consumer at the request of the entrepreneur
- functionality of digital content and technical means of its protection
- relevant interoperability of digital content with hardware and software the entrepreneur knows or should know about
- the possibility of using out-of-court complaint and claim pursuing procedures, and how to access these procedures.
Apart from that:
- if the agreement is concluded on behalf of another entrepreneur, you need to provide identification information of that entrepreneur
- in the case of a public auction, the entrepreneur details may be substituted with details of the auction organizer
- according to EU regulations (Regulations no. 524/2013), online shops must inform consumers about the possibility to resolve conflicts electronically via the ODR platform.
Moreover, the entrepreneur needs to ensure that, while placing an order, the consumer explicitly confirms they know they are obliged to pay.
Seller's privacy policy
In order to keep your buyers informed on how you process their personal details, you can add your own privacy policy on your account. Check how to do that and where the buyers will see it.
Other obligation of the entrepreneur
- The entrepreneur needs to explicitly provide clear and legible information on delivery restrictions and accepted payment methods at the beginning of the ordering process at the latest.
- At the time the consumer expresses their will to be bound by the agreement at the latest, the entrepreneur is obliged to obtain the consumer's explicit consent to any additional payment beyond the agreed compensation for the entrepreneur’s main contractual obligations.
- The entrepreneur is obliged to inform the consumer of the loss of their right to withdraw from the agreement when they consent to obtaining the digital content which is not recorded on a tangible medium, and to obtain their consent to supply that content.
- The seller is obliged to provide the buyer, prior to the conclusion of the agreement, clear, comprehensible and not misleading information in the Polish language, sufficient for the proper and full use of the item sold, in particular:
- item type
- name of manufacturer or importer
- safety label and the declaration of conformity required by separate regulations
- information about the admission to trade in the Republic of Poland
- energy efficiency information ― depending on the type of item
- details specified in separate regulations.
What the unit price is and how it works
You can find the price converted to a corresponding unit of measure in select categories.
In select categories, we display the price converted to an appropriate unit of measure (for example, liter, kilogram, or meter) on the offer list, product list, and product page. You can find it under the product price.
What the unit price is
Price per unit, or unit price, is the price of a single product or service, the quantity or number of which is expressed in units of measurement. The unit price is the final price that includes VAT and all other taxes.
According to article 4 of the act on the information about prices of goods and services (available in Polish), at a retail venue, the price per unit of goods (services) should be visible to the customer and allow them to easily compare prices.
How it works
- We display the unit price on the offer list, product list, and product page in select categories.
- We calculate the price per unit automatically in categories where parameters related to units of measurement and quantity of products are mandatory. You do not need to take any action!
- If you do not complete parameters related to the units of measurement and quantity of the product in categories where we do not require it — we will not display the unit price.
- We will only display the unit price in offers in the Buy now format.
- In select categories, you will see the following sorting option on offer lists: unit price: low to high
- In product sets that consist of several units of a single product, we calculate the unit price based on the number of units in the set. If you sell such sets, provide in your offer parameters — such as weight, capacity, or length — for one product unit. It will allow us to display the correct unit price in your offers.
- We do not display the unit price in product sets composed of different products.
What you can gain
Your offers will be even more attractive to customers.
You can also complete parameters related to units of measurement and quantity of product in categories where we do not require that. If you do that, customers will see the unit price in your offers, on the search list, and product page.
The unit price attracts customers because:
- it makes it easy to compare product prices
- it allows them to decide on the purchase faster.
