Rules of selling on Allegro
Prohibited charging of additional fees
Adding additional fees to the final price is not allowed, except for delivery costs, as specified in carriers' price lists.
Charging additional fees after finalizing the transaction is not allowed. Learn more below to avoid any confusion in this matter.
Additional fees and delivery costs
Adding any extra costs to the final price is not allowed. You cannot demand that the buyer pays more than the price of the purchased item (both through buy now or bidding) and the costs of the selected delivery option.
You can charge only the actual delivery costs, based on the price lists of courier and postal companies. The delivery cost covers both the base price for sending the parcel, and additional services offered by courier and postal companies, such as insurance. You can round off the delivery fee to make settling the costs easier for the buyers.
You cannot add the parcel preparation costs (such as packaging or service costs) to the final price – these should be included in the product price.
Additional commissions
Charging the buyers for the Allegro commission fee or the payment card processing fee is prohibited.
Net prices
It is also prohibited to declare that the amount bid is a net price (excluding VAT), or that a certain percentage of the price must be added in order to obtain a VAT invoice. All prices are gross prices (including VAT), expressed in PLN. If you have a business, you are obliged to issue an invoice without any additional charges on the buyer’s request.
Customs
If the purchase is subject to customs, the item price does not have to include the customs duty.
Contests and promotions
You cannot organize competitions or promotions where the winner is chosen by lot or by reaching a certain purchase value.
In order to avoid abuse and in relation to applicable law, on Allegro you cannot organize contests or promotions for customers in which the winner is selected by drawing lots, or by achieving an appropriate level of purchase value.
In many cases, conducting promotional lotteries where you offer certain prizes in kind or in cash requires a permit from the competent authorities as well as creating detailed terms & conditions each time, which must also be approved by the competent authorities.
Additionally, buyers can generally assert claims regarding the course of a given contest (a game of chance, a promotional lottery) only if it was conducted on the basis of a permit in accordance with the rules described above.
Currently, the vast majority of contests in the form of games of chance or promotional lotteries organized by sellers do not meet these requirements. We also do not have the ability to reliably verify the permits granted and check if the content of the terms & conditions is accepted, which is why we decided to ban such forms of promotion completely.
Examples of banned forms of contests and promotions
- a prize draw from the list of all buyers or bidders from the last month
- a promise to transfer the prize to the buyer who makes purchases for a specific or highest amount in a given period
- offering coupons that entitle buyers to participate in a contest or draw organized by the seller
- awarding the best comments or reviews.
Examples of permitted forms of promotion
- offering coverage of transport costs if certain conditions are met (for example, when using the [buy now] option)
- offering a percentage or amount discount if certain conditions are met (for example, a one-time purchase for a specific amount).
For each permitted promotion, you are required to specify its terms in detail so as not to leave any understatements. You should also answer every customer question about a given promotion.
Sales outside Allegro and bypassing fees
At Allegro, it is not allowed to complete the purchase outside the website or to suggest such a possibility, for example, to bypass fees. This applies to offers with the buy now or bidding option.
You cannot list offers that enable or suggest concluding a transaction outside Allegro. This ban also concerns offers that let you not pay the sales commission.
Examples of forbidden phrases in the offer description
- Suggesting or encouraging customers to purchase a particular item outside Allegro. For example: "Sprzedaż tylko poprzez mój sklep internetowy" (“Sales only through my online store”), "Propozycje składaj telefonicznie, dogadamy się poza Allegro" (“Call us to strike a deal outside Allegro”).
- Claiming that the transaction will take place even if the buyer does not reach the minimum price. In such cases, the sales contract is not concluded and parties do not have to fulfill their part of the deal. For example: "Sprzedam, nawet jeżeli cena minimalna nie zostanie osiągnięta" (“You can buy it even if you do not reach the minimum price”).
- Informing that the buyer needs to pay the cost of an item in part or in full outside Allegro. For example: "Cena w ofercie jest poglądowa, zapytaj o cenę osobiście" (“The price in the offer is illustrative. Contact us to check the true price”), "Licytujesz 1 sztukę, lecz kupujesz cały komplet" (“You bid for one unit but buy the whole set”), "Wylicytowaną kwotę pomnóż razy cztery" (“Multiple the final price by four”).
- Informing about the possibility to negotiate the price or offer terms, for example: “Cena do negocjacji. Dzwoń!” (“The price is negotiable. Call us!”), „Za dodatkowe 20 zł dorzucę coś ekstra” (“Pay additional 20 PLN and I will add something extra”), “Jeżeli ten rozmiar ci nie odpowiada, zapytaj o inne” (“If you are interested in different sizes, contact me”).
- Advertising items not listed on Allegro or suggesting buyers to contact you before they place an order. For example: “Szukasz czegoś innego? Skontaktuj się z nami" (“Looking for something else? Contact us”), „Na tej ofercie sprzedaję stół. Krzesła mogę wystawić na życzenie w osobnej ofercie" (“I sell a table in this offer. I can list chairs in a separate offer on your request”), "Zanim zalicytujesz zadzwoń!" (“Call us before bidding!”), "Przed licytacją sprawdź dostępność" (“Check availability before bidding”).
- Blatant overcharging for the shipping costs combined with undercharging for the item in order to minimize the sales commission.
Selling outside Allegro and avoiding fees are unfair competition practices. It harms both honest sellers and our selling platform.
