What regulations regarding waste and packaging apply in Slovakia
Check how to meet obligations to collect and recycle waste and packaging.
When you ship your orders to other European Union countries, make sure you do it legally. Pay particular attention to waste and packaging regulations — including those that apply in the country to which you are shipping. In this case — Slovakia.
If you sell products subject to the extended producer responsibility (EPR) to Slovakia, you should:
- enter into relevant registers
- comply with the recycling regulations
- label your products properly.
What products are subject to the extended producer responsibility in Slovakia
In Slovakia, the rules concerning the extended producer responsibility are regulated by the Zákon zo 17. marca 2015 o odpadoch a o zmene a doplnení niektorých zákonov — the act also known as suo.
The act mentions the following product categories:
- packaging (§ 52 suo)
- non-packaged products (§ 73 suo)
- electrical and electronic equipment (§ 32 suo)
- batteries and accumulators (§ 42 suo)
- vehicles (§ 60 suo).
Glossary — terms you should know
The entity that places the packaging on the market — a person or a company that sells products in the packaging in Slovakia — even if they do not run a business activity in that country.
Packaging — a product that allows proper transport, delivery, protection, and display of goods. It can be made of any material. It does not matter whether it is only used for transport and will be removed before the sale or the product will be sold in it.
Placing the packaging on the market — the moment when the packaging (itself or with the product) enters Slovakia for the first time, for example, arrives from another country. It does not matter whether customers will use it on their own or resell it.
Packaging manufacturer — a natural person that:
- uses the packaging to pack goods and places them on the market under their trademark
- is a person for whom the goods are packed and placed on the market under their trademark
- places the packaged goods on the market in a way different from the ones described above or transports such goods or orders their transport abroad Slovakia and distributes or places them on another country's market
- as a distributor, hands the packaging over to the end user for instant packing of goods, paid or free of charge
- as a distributor, uses the packaging to wrap the distributed goods or their parts or to fill it with such goods
- places the packaging on the market — that does not apply to a person who delivers the unused empty packaging to the people mentioned above.
Check your most important formal obligations
As a Polish seller that introduces their products onto the Slovak market:
- Check whether the selling of selected products is allowed in Slovakia. Remember that you have to comply with Appendix No. 1 of Allegro Terms & Conditions. You will find there the information on goods prohibited and restricted on Allegro.
- Make sure you hold all the intellectual property rights necessary to introduce the product in Slovakia (trademarks, patents, copyright).
- If you sell products of animal or plant origin, electronics, dietary supplements, or pyrotechnic products, make sure to check the policy of selling products to Slovakia. Those are the examples of product categories that require special attention and are subject to additional regulations.
- Make sure you have entered the necessary registers. Pay particular attention to waste and packaging regulations.
What the most important seller's obligations concerning waste and packaging are
- According to the act, before you place products on the Slovak market, you need to register with the Slovak Ministry of the Environment. If you do not have a registered office in Slovakia, the most convenient way to fulfill this obligation is through a company with a special permit to collect packaging waste. Check the list of approved manufacturer responsibility organizations.
- Enable the possibility to return packaging and explain to customers how and where they can do so.
- Declare how much packaging you will place on the Slovak market.
- If you mark what they are made of on the packaging, apply markings compliant with the UE requirements.
- Make sure you recycle packaging.
If the local authorities ask you to provide proof that you meet those obligations — you have to do it.
If you sell in the Electronics category
What obligations you need to meet
- Register with the Slovak Ministry of the Environment.
- Secure the collection, processing, and recycling of devices and electronic waste. This means your customer may return the used equipment stationary, by courier, or by an authorized third-party company — and you must provide them with the opportunity to do so.
- Label the products properly — for example, with the crossed-out bin symbol or the name and address of the manufacturer.
- Inform about product components and their recycling, as well as about the absence of hazardous substances.
- Prepare the documents you will add to the product in Slovak — for example, user manuals, product cards, labels.
What documents you need to have
When you place products from the Electronics category on the Slovak market, make sure to:
- label them properly — include the name/logo, address of the manufacturer and importer, batch, and serial number
- provide the CE marking that informs about the absence of noxious, hazardous, or risky substances
- place the crossed-out bin symbol on the equipment, packaging, or documents attached to it — it indicates that a given product cannot be disposed of together with other waste
- provide technical documentation that specifies product parameters and features
- attach a leaflet informing that the device is manufactured in a way that makes it easy to disassemble and reuse (this is the manufacturer's responsibility)
- attach the declaration of conformity of technical documentation with product properties.
If you do not have an official registered office or fixed establishment in Slovakia, you are obliged to authorize an external entity that:
- will represent you
- will guarantee that you meet the above obligations.

If you sell in the Batteries and accumulators category
What obligations you need to meet
- Register with the Slovak Ministry of the Environment.
- Secure the collection, processing, and recycling of used batteries and accumulators. This means your customer may return the used equipment stationary, by courier, or by an authorized third-party company — and you must provide them with the opportunity to do so.
- Inform about the possibility of having the deposit fee reimbursed — including the amount of the deposit fee.
- Label the products properly — for example, with the crossed-out bin symbol or the name and address of the manufacturer.
What documents you need to have
When you place products from the Batteries and accumulators category on the Slovak market, make sure to:
- label them properly — include the name/logo, address of the manufacturer and importer, batch, and serial number
- provide the CE marking that informs about the absence of noxious, hazardous, or risky substances
- place the crossed-out bin symbol on the equipment, packaging, or documents attached to it — it indicates that a given product cannot be disposed of together with other waste
- provide technical documentation that specifies product parameters and features
- attach a leaflet informing that the device is manufactured in a way that makes it easy to disassemble and reuse (this is the manufacturer's responsibility)
- attach the declaration of conformity confirming technical documentation with product properties.
If you do not have an official registered office or fixed establishment in Slovakia, you are obliged to authorize an external entity that:

How to settle the packaging you introduce to Slovakia
If you place packaging on the Slovak market, you must comply with the obligations resulting from the extended producer responsibility. The Slovak law is stricter in this respect than, for example, the Czech law.
In Slovakia, the issues mentioned above are regulated by Zákon zo 17. marca 2015 o odpadoch a o zmene a doplnení niektorých zákonov (suo). According to the act, before placing products on the Slovak market, you must register at the Slovak Ministry of the Environment. Designate an authorized representative if you do not have a registered office in Slovakia. The authorized representative is a person who, based on a written power of attorney, can, for example, conclude an agreement with the producer responsibility organization and order the registration in the Slovak ISOH register — the counterpart of the Polish BDO (Waste Database Number) — on your behalf.
That way, you will meet the environmental obligations concerning, for example, the collection, transport, management, and recycling of waste. Technically, those obligations are imposed on the entrepreneur who places the products on the market — in practice, they are fulfilled collectively, by specially appointed entities.
How to designate an authorized representative
You can contact the waste management organizations directly. Each organization has recommended authorized representatives they cooperate with — they can provide you with the representatives' contact details.
Once you conclude an agreement with the waste managing organization, your obligations will be:
- to mark the packaging in accordance with the EU standards
- to keep an accurate record of the packaging and products you place on the market.
How to meet the obligation to recycle products
Products that are subject to recycling fees in Slovakia include:
- electrical equipment
- batteries
- accumulators
- packaging
- unpackaged products.
To organize a system for collecting those types of products and recycling them, contact an authorized manufacturer responsibility organization.
The Allegro returns policy — information for sellers
We want the returns policy on Allegro to be the same in all the marketplaces. If you sell on Allegro, you have the same rights and obligations that concern returns regardless of the marketplace.
The returns policy is a set of rules that apply to product returns on Allegro. It takes into account the regulations that apply to each marketplace. We want to make returns easy and convenient for buyers and less time-consuming or costly for sellers.
Returns rules on Allegro
Below, you can find the key information concerning the return of products. Possible differences in the product return rules are marked with the information about which marketplace they concern. If there is no such information — the same rule applies to all the countries.

How can the buyer return a product?
There are several ways of returning products:
- free of charge — if the purchase was made within Allegro Smart! or within the free consumer returns promotion
- with the paid return, available in selected marketplaces
- at their own expense.
When the buyer uses the free or paid return on Allegro — in the Returns tab, you will see a timeline, return status, and a link that will redirect you to the details on the carrier's website.
The buyer can also return the product on their own. In that case, we will not send you the parcel tracking number. However, the buyer can do it. They can, for example, send you such a number in a text message.
How much time do I have to make a refund?
It depends on the reason for return. In the case of:
- cancellation of a purchase — you have to refund the buyer within 2 working days
- withdrawal from the agreement — you have to refund the buyer within 7 days from the day on which the status of the returned parcel changed to Delivered, but no later than 14 days from the moment you get a product return form from the buyer
- complaint due to the product defect — you have to refund the buyer immediately.
What amount should I refund the buyer?
It depends on the reason for product return:
- return due to withdrawal from the purchase (it also applies to purchases paid for and canceled) — you refund the buyer the value of the goods and the delivery cost (it can be the lowest cost indicated in the price list)
- return due to complaint (product defect) — once the complaint is accepted, you refund the buyer the value of the goods, the delivery, the return parcel, and other justified costs.
If the buyer returns the parcel free of charge within Smart!, you do not need to refund them the cost of the return parcel, as there has been no such cost.
When can I refuse to accept the return on Allegro?
You are not obliged to accept the return of certain products.
In the case of a limited return, you do not have to accept returns of the following products:
- audio and visual recordings, computer programs that the buyer received in sealed packaging and opened — for example, if they removed the protective film from a factory-sealed game or a music/video disc
- products delivered in sealed packaging that cannot be returned after opening for health or hygiene reasons — for example, underwear, pregnancy tests, electric toothbrush heads, contact lenses, and masks
- digital content that is not saved on a tangible medium if the service performance has begun with the explicit consent of the buyer before the deadline to withdraw from the agreement and after the seller informed the buyer about the loss of the right to withdraw from the agreement — for example, downloading an eBook or a video game code
- products that are permanently combined with other things after delivery — for example, motor oil the buyer pours into the car.
In the case of an exclusion of the right to return (No return), those are:
- products with a short shelf-life or perishables — for example, cottage cheese, fresh vegetables, plants, and seedlings.
- daily newspapers, periodicals, or magazines (except for subscriptions)
- services or products whose price or compensation depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline to withdraw from the agreement — for example, investment products like gold bars, collectible gold coins, silver, platinum
- made-to-order products manufactured according to the buyer's instructions — for example, a T-shirt with a print designed by the buyer
- medicinal products, as defined in pharmaceutical law, food products intended for particular nutritional uses, and medical devices from the pharmacy — for example, OTC medications (the category available only on allegro.pl.)
How long is the complaint liability period?
In all the Allegro marketplaces, the basic period of statutory liability for non-conformity of goods with the agreement is 2 years.
In Hungary (allegro.hu), there is another measure — the commercial warranty. The commercial warranty is valid:
- for 2 years from the purchase — if the product price is between 10,000 and 250,000 HUF
- for 3 years from the purchase — if the product price exceeds 250,000 HUF.
Goods from the Fashion and Footwear categories not covered by the commercial warranty are an exception.
How much time do I have to process a complaint?
Under the Allegro Terms & Conditions (5.12), if the buyer expects a refund as part of the complaint process, you need to consider the complaint within 14 days of its submission.
Statutory deadlines:
On allegro.pl — 14 days to decide on a complaint. On allegro.cz and allegro.sk — 30 days to decide on a complaint. On allegro.hu — under Hungarian law, you need to respond to the consumer's request within 5 days. Additionally, if you accept the complaint, and the exchange or repair of the product takes longer than 15 days — you need to inform the buyer about it and provide the estimated time of the repair or exchange. 30 days is the general deadline for handling complaints.
How to refund the buyer?
If the buyer has paid for the purchase in advance, you can make a refund through Allegro Finance. You will do it using the refund form in the Orders and Returns tabs.
You can refund buyers also for orders paid for on delivery on:
- allegro.cz
- allegro.sk
- allegro.hu.
It will be possible if the buyer returns the purchase through Allegro, completes the return form on our website, and provides the details of the account for refund. Learn more about it.
Does the rejection of the complaint entail any additional obligations for the seller?
On allegro.hu, allegro.pl, and allegro.cz — you do not have any additional obligations due to the rejection of the complaint.
On allegro.sk
In connection with the changes in the Slovak law — from July 1, 2024, you do not need to provide an expert opinion when you reject a complaint about the purchase on allegro.sk. You only need to inform the buyer about your decision.
That change applies to purchases made after July 1, 2024. If you reject complaints that concern purchases made before July 1, 2024, you still need to provide an expert's opinion. That applies to complaints submitted up to 12 months after the purchase.
You must present the expert opinion to the buyer within 14 days of rejecting their complaint. The assessment may be translated into Slovak — it does not have to be the certified translation. The person who issues the assessment does not have to come from Slovakia — learn more about who can issue the assessment.
If the buyer files a complaint more than 12 months after the purchase — the rejection of such a complaint does not have to be based on the expert's assessment — you do not need to send it to the buyer. However, you have to provide the buyer with the details of an expert to whom the buyer can send the product for assessment — if they want to hear their opinion. If the buyer provides the expert's assessment that confirms the validity of the complaint — you are obliged to accept the complaint and compensate for the costs related to the preparation of the expert's assessment.
Who can issue the expert's assessment and what should it include?
According to Slovak Article 2, section n) of Act No. 250/2007 Coll., Consumer Protection Act, the expert's assessment must be issued by:
- an impartial expert or
- an authorized, notified, or accredited person or
- a person authorized by the manufacturer to carry out warranty repairs.
The person who issues the assessment does not have to come from Slovakia. It may be someone from Poland or another country who is authorized to perform warranty repairs in a country within the European Union or the European Economic Area (EEA).
What the expert's assessment should include
- The details of the expert who carried out the assessment — who should be impartial, even if they were authorized by the manufacturer themselves.
- Precise identification of the assessed product.
- Description of product condition.
- Assessment's result.
- Date the assessment was carried out.

When a buyer from Czechia returns a parcel to Poland within the free Allegro Smart! return or has purchased the PPL label, they dispatch it at the PPL point. Then, the PPL carrier hands the parcel over to the DHL carrier in Poland.

When the buyer dispatches a return parcel free of charge within the Smart! service or by purchasing the label (it applies only to allegro.cz, allegro.sk, and allegro.pl) — the return label contains the parcel's number. Enter the number in the search field of the Returns tab. That way, you will find the order that a given return concerns. In the order details, you will check, among other things, the details of the buyer who has returned the parcel. In the Returns tab, you will also check which country the return comes from.

We try to ensure that Returns policy on Allegro is the same on all markets. If you sell on allegro.pl and, for example, allegro.cz , you will have the same rights and obligations regarding Allegro returns on both markets.
Allegro has Returns policy, i.e. one standard for returning a product - regardless of the market. We want returns to be easy and quick For Buyers, and less time-consuming and less costly For Sellers .

If you sell on allegro.cz, you are bound by the allegro.cz Returns policy allegro.cz. If you sell on allegro.pl and allegro.cz - the rules of both the allegro.pl Returns Policy and allegro.cz.
Assumptions The return policy is almost the same on all Allegro markets. However, it may happen that, for legal reasons, there are different regulations in one market than in the other market.

How can buyer return goods ?

Buyer can return goods in several ways:
- for free, within Smart (if purchase was also within Allegro Smart)
- buy a paid refund via Allegro.

- Buyer can also send goods back on his own and provide the seller with a tracking tracking number .
How quickly should seller return the money to the buyer?

It depends on the reason for the return. In case of:
- cancellation of purchase -- 2 business days
- withdrawal from the contract - 7 calendar days, counted from the date of changing the status of the return shipment to Delivered, but no later than 14 days from the moment seller receives the goods return form from the buyer
- complaint due to a product defect -- immediately.
How much should be refunded to the buyer?

It depends on the reason for returning the item:
a) refund for withdrawal from purchase (also applies to paid and canceled purchase) - seller returns the value of the goods and delivery cost incurred by the buyer (this may be the lowest cost indicated in the price list).
b) refund due to Complaint (product defect) - after a positive consideration of the complaint, seller returns the value of the goods and the costs of delivery, return shipment and any other reasonable costs incurred by the buyer.
If buyer took advantage of the free return within Smart, you do not have to pay the buyer the cost of return shipping, because there was no such cost.
When can seller refuse to accept a return on Allegro?

Seller may refuse to accept the return of certain products.
In the case of a limited refund , these products are:
- sound and visual recordings, computer programs that you receive in a sealed package and open it - for example: you remove the protective foil from a brand new game or a music or film disc

Which carrier handles returns to Poland from allegro.cz?
Buyer on allegro.cz can use the return form and send product back to the Polish seller. The return shipment can be sent by:
- for free, as part of the Allegro Smart service
- at your own expense (for example, you may purchase a paid PPL label/code).
If customer from the Czech Republic returns a shipment to Poland, he or she sends it to a PPL point. The PPL carrier then hands over the parcel in Poland to the DHL carrier, who then delivers the return shipment to the seller.
How will I know who sent refund if buyer is from the Czech Republic?
If buyer sent the return shipment with free returns as part of the Smart service or as part of the PPL label purchased by him on Allegro, the parcel number will be provided on the return label. Enter this number in the search engine, in the Returns tab. This way you will find the purchase offer and find out who the sender of the return shipment is.
How to prepare products for sales in the foreign marketplaces
If you want to sell your products abroad, start by getting familiar with the local law. Learn what you should pay attention to when selling in the Czech, Slovak, and Hungarian marketplaces.
Labels
Prepare product labels in the language of the country where you want to sell — Czech, Slovak, or Hungarian. If you want, you can also provide translations into other languages — for example, English.
You can place the label on the product or provide it as a leaflet. Provide all data, such as weight or volume, in metric units.
Each label must contain:
- product name
- manufacturer/distributor data
- country of origin
- instruction for use — if required for your product or if you include such instructions in another language.
Some product groups need to meet additional requirements. They depend on the type and purpose of the product in question. We have gathered some examples in a table.

All of the above rules are in line with European Union standards.
Product and offer description
The provisions of the Czech, Slovak, or Hungarian law do not explicitly address the product description — they only focuses on labels. If you sell on allegro.cz, allegro.sk, or allegro.hu, you are subject to the provisions of the Allegro Terms & Conditions. We have gathered the rules regarding offer and product descriptions in Appendix No. 2.
Describe your product in a way that allows buyers from international marketplaces to recognize it. Ensure that your information is complete, clear, and legible — so as not to mislead customers. Provide:
- offer description in Czech, Slovak, or Hungarian
- price in CZK, EUR, or HUF
- information about the product and its characteristics
- manufacturer's data
- product weight, number of units, or size
- other information necessary for identifying and using the product.
It is also a good idea to include information you put on the product label in the description — especially if your product has to meet additional requirements. The information about material composition or energy labels may be key for the buyer.

Extended producer responsibility - information for sellers
Extended Producer Responsibility, abbreviated as EPR, is a requirement that stems from the EU directive on packaging and packaging waste.
What extended producer responsibility (EPR) is
Extended producer responsibility (EPR) is the concept that manufacturers, importers, and distributors are responsible for the environmental impact of the products they introduce throughout the product life cycle. The introduction of the EPR regulations aims at decreasing the amount of waste and improving the frequency of recycling.
In Poland, the process of adjusting national regulations to the EU directive is still ongoing. In other countries, such regulations are already in effect.
Whom the EPR regulations apply to
The EPR regulations apply to manufacturers and all entities that distribute products to European markets. In some countries, the EPR regulations apply also to online stores and sellers that operate on sales platforms — like Allegro. The regulations may differ depending on the UE country and the product category — learn more in the Categories of products regulated by the EPR section.
Example
On Allegro, you sell and ship various products to Germany. To do it in compliance with applicable regulations, you have to — among others — register in a German LUCID packaging registry that includes delivery packaging. We are obliged to check whether you have such a number — you provide it in a dedicated field in your account details. We confirm whether the number is valid on an ongoing basis.
Limitations in sales
In some EU countries, regulations do not allow to sell and ship to these countries products without valid EPR numbers. That is why your sales to these countries may be limited if you do not add EPR numbers valid in a given country to your account. That means buyers from these countries may not be able to see your offers or pay for their order in such offers.
Example 1
The buyer sets Germany as the country of delivery in Localization settings. They want to browse Allegro offers in the Toys category. They will see only offers from sellers who provide the number from the German LUCID registry in their account details.
Example 2
The buyer sets Poland as the country of delivery in Localization settings, although they want to order the product to another country. They buy the product and during payment provide the delivery address in Germany in the delivery form. As the seller does not provide the LUCID number in their account details, the buyer cannot pay for their purchase and place the order.
In other countries, where the sellers do not have to register in the national EPR registry, or the regulations do not apply to sellers on online platforms, buyers still see the offers of the seller and can buy in them.
How to add an EPR number on your Allegro account
To add EPR numbers:
- Go to the Account details tab.
- Go to the EPR (extended producer responsibility) numbers section and click [check data].
- Enter the EPR numbers you have in the fields assigned to given countries.
- Click the checkmark icon [✓] to save.
Categories of products regulated by the EPR
Categories of products are specified in the UE directives. However, the EPR regulations and requirements they involve differ in each country — each country introduces regulations of a given directive through its own acts. Different countries use different EPR numbers — it depends on whether the product belongs to the category governed by these regulations in the given country.

The list of categories and devices subject to the WEEE Directive
WEEE Directive (Waste Electrical and Electronic Equipment Directive) divides the electrical and electronic equipment into 6 categories.
Category 1
Temperature exchange equipment — for example, refrigerators, freezers, air conditioner appliances, heat pumps, heaters containing oil, and other temperature exchange equipment that uses fluids other than water to exchange temperature.
Category 2
Screens, monitors, and equipment containing screens having a surface greater than 100 cm2 — for example, screens, TV sets, LCD picture frames, monitors, laptops, notebooks.
Category 3
Lamps — for example, straight fluorescent lamps, compact fluorescent lamps, fluorescent lamps, high-intensity discharge lamps, including pressure sodium lamps and metal halide lamps, low-pressure sodium lamps, LED.
Category 4
Large equipment — having any external dimension of more than 50 cm — including:
- household appliances
- IT and telecommunication equipment
- consumer equipment
- luminaires
- equipment reproducing sound or images
- musical equipment
- electrical and electronic tools
- toys
- leisure and sports equipment
- medical devices
- monitoring and control instruments
- automatic dispensers
- equipment for the generation of electric currents.
This category does not include equipment included in categories 1 to 3 or 6.
Category 5
Small equipment — having no external dimension of more than 50 cm — including:
- household appliances
- consumer equipment
- luminaires
- equipment reproducing sound or images
- musical equipment
- electrical and electronic tools
- toys
- leisure and sports equipment
- medical devices
- monitoring and control instruments
- automatic dispensers
- equipment for the generation of electric currents.
This category does not include equipment included in categories 1 to 3 or 6.
Category 6
Small IT and telecommunication equipment — having no external dimension of more than 50 cm — for example, telephones, GPS, pocket calculators, routers, PCs, printers.
GERMANY
Packaging and packaging waste directive — in Germany, introduced as an act on packaging known as VerpackG. If you want to sell and dispatch products to Germany, you have to register in the German national registry and provide the LUCID number on your Allegro account.
Directive on waste electrical and electronic equipment (WEEE) — in Germany, introduced in the form of an ElektroG act. The WEEE Directive divides electronic and electrical equipment into 6 categories. If you want to sell and dispatch to Germany products from those categories, you have to register in the national Stiftung EAR registry and provide the WEEE number on your Allegro account. AUSTRIA
In Austria, the new regulations on extended manufacturer responsibility are in force from January 1, 2023, and apply to:
- packaging, including product packaging, transport packaging, and delivery packaging
- electrical and electronic equipment (EEE)
- batteries.
Who is subject to Austrian regulations
In Austria, the definition of manufacturer refers to "any natural or legal person who develops, manufactures, handles, processes, sells or imports waste-generating products or the elements and materials used to manufacture them".
Electrical and electronic equipment (EEE) and batteries
An economic entity is considered a manufacturer if they:
- manufacture products subject to EPR requirements in Austria and sell domestically and/or
- import products subject to EPR requirements to Austria and/or
- sell a product subject to EPR requirements in Austria and do not have a registered company address in Austria.
Packaging and packaging waste
An economic entity is considered a manufacturer if they:
have a registered office or a branch in Austria and:
- act as an importer — import to Austria packaged goods that are to be transferred in Austria and/or
- act as an importer for their own purposes — import to Austria packaged goods for the purposes of their own business, and the packaging is manufactured in their own facility
- pack goods in packages — they are a packer.
do not have a registered office or branch in Austria and act as a distance seller. That is, they transfer goods to private end consumers by means of distance selling or mail-order selling and sell (meaning place on the market) the packaging or the packaged goods — commercially, regardless of the method of distribution.
Manufacturer's responsibilities
Electrical and electronic equipment (EEE) and batteries
If you are a manufacturer, you are required to follow an approved waste collection and recycling system. Entrepreneurs who do not have a registered office in Austria should also conclude agreements with authorized representatives.

Packaging and packaging waste
It is obligatory to register by concluding an agreement with an approved waste collection and recycling system. One of the main responsibilities is reporting the number of used packaging.
As of January 1, 2023, you have to appoint an authorized representative. The proxy, who must be based in Austria, assumes obligations to EPR organizations and local authorities on behalf of the business entity.
POLAND
In Poland, the BDO (database of products, packaging, and waste management) register is in force. According to the law, from January 1, 2020, everyone who conducts business activity indicated in Article 50 (1) and Article 51 (1) of the Act on Waste (the text available only in Polish) is obliged to register their activity in the BDO.
