What obligations the CPR 2 (the new CPR) imposes on you regarding construction products

What the CPR is
EU regulation 2024/3110, known as the CPR 2 or the new CPR (Construction Products Regulation), will introduce changes that apply to selling construction products remotely. It will come into effect on January 8, 2026, and applies also to sales on platforms like Allegro.
The legal change obliges you to provide additional information in offers of construction products.
To whom the new CPR applies
It applies to you if you sell:
- on a business account
- in certain categories.
The regulation applies to several products not typically associated with construction, for example: power cords, space heaters, fire suppression systems.
What details you will need to provide
Your offers will be compliant with the law if you provide the following information:
- manufacturer's details: manufacturer's name and registered office address, or an identifying mark that allows an easy and clear identification of their name and address
- authorized representative's details (applies to manufacturers that do not have a branch in the European Union or those that have designated their representative): authorized representative's name and registered office address, or an identifying mark that allows an easy and clear identification of their name and address
- unique identification code of the product type: reference number given by the manufacturer that identifies a given model
- code of the Declaration of Performance and Conformity: a code assigned by the manufacturer to the Declaration of Performance and Conformity (DoPC) that they issue
- CE marking
- ID of notified body or bodies: an ID of an entity that verifies CE — checks the product type, and assesses factory production control.
How to complete the details
Details of the manufacturer and the authorized representative
These details are likely already completed — details of the manufacturer and the authorized representative are also required by the GPSR.
Product identification code and code of the declaration of performance
In regard to the CPR regulation, we will add new parameters describing the product:
- Product Identification Code
- Declaration of Performance and Conformity Code.
CE marking
CE marking is related to the Condition parameter.
If you list an offer with the condition parameter set to New, and check the CE box in the Certificates of conformity parameter:
- in the Date of certification parameter, you will need to provide the year when the certificate was assigned to your product
- you will need to complete the CE Verification Entity ID parameter.
If you list an offer with the condition parameter other than New, you will need to:
- provide the year when the product was disassembled
- provide the year when the CE marking was given to the used product
- complete the CE Verification Entity ID parameter.
Example
You are listing an offer with used bricks from a house disassembled 2 years ago. You set the product condition to other than New. You provide the year when the house that the bricks come from was disassembled — 2023. Then, you provide the year 2025 and, as a result, the bricks get this year's CE marking. When you assign the CE marking, you declare that you take full responsibility for the conformity of the bricks with the CPR requirements and that there is documentation related to them.
Where you can obtain the required information
If you cannot provide the details required by the law, because you do not have complete product documentation, contact the manufacturer or importer of the product. You have the right to demand this information from suppliers to sell in compliance with the law.
