Reminder: After September 2, you will list the products of certain brands only after you accept the Brand Protection Conditions
If you have a business account and list protected brands' products — confirm that you know the Brand Protection Conditions by September 2. We can terminate all your offers with the products of protected brands if you fail to do that. You will also not list new offers with those products or relist the offers that ended.
As announced, today, we have clarified the rules for selling products of certain brands. They concern the so-called protected brands we list in Appendix No. 1 of our Terms & Conditions.
The new provisions will apply from September 2, 2024. However, you can already prepare for those changes.
What provisions we added to our Terms & Conditions
- On Allegro, you can list offers with products of protected brands only if you have a business account and confirm that you know the Brand Protection Conditions.
- We can prevent you from listing new offers, relisting ended offers, and/or removing active ones with products of a given brand or all brands from the list. We will do that if an authorized entity informs us that the product from your offer is non-genuine.
- We may impose a contractual penalty of 2,500 PLN on you — both the second and third time it is reported that you offer a non-genuine product of one of the protected brands.
We have also updated the list of protected brands. You will find it in this file.
What it means for you
- If you do not offer protected brands' products — you do not need to do anything. You can list your offers as before.
- If you have a regular account and list protected brands' products — from September 2, you will not do that. The sale of protected brands' products will be possible only on business accounts. On a regular account, you will list products of those brands only on Allegro Lokalnie.
- If you have a business account and list protected brands' products — confirm that you know the Brand Protection Conditions by September 2. We can terminate all your offers with products of those brands if you fail to do that. You will not list new offers with those products or relist the offers that ended.
How you can confirm that you are familiar with the Brand Protection Conditions
- Go to the Brand Protection tab.
- Read the Brand Protection Conditions. Read not only the information in the tab but also go to the Terms & Conditions and its appendices that we link to in the Brand Protection Conditions section.
- Go to the Confirm that you are familiar with the Brands Protection Conditions section. There select the I know and understand the Brands Protection Conditions option.
- Click [confirm]. Done!
What the Brand Protection Conditions are
The Brand Protection Conditions are based on the provisions in our Terms & Conditions and its appendices.
- Sub-paragraph 8.14 of the Allegro Terms & Conditions — there, you will learn what sanctions we can impose on sellers of non-genuine products. Learn more.
- Part II of Appendix No. 1 — we published the list of brands covered by the Brand Protection Conditions in that part. There, we also inform you that:
- you can list offers with the products of those brands only on a business account
- you cannot list offers with the products of those brands if your company is located or registered outside the European Economic Area and you dispatch products from outside the European Economic Area.
- you cannot list offers with the products of those brands if your company is located or registered in a country that is part of the European Economic Area, but you dispatch products from outside the European Economic Area and you do not issue invoices.
- Appendix No. 4 — there, you will find the information that apart from the VAT we will also settle the contractual penalties we can impose on sellers who do not follow the Brand Protection Conditions.
- Appendix No. 13 — from that appendix, you will learn that you can list the products of protected brands on Allegro Lokalnie only on a regular account. Once you do it, your classified ad will be displayed only on Allegro Lokalnie — we will not display it on Allegro.
Why we have introduced the Brand Protection Conditions
- We restrict unfair competition. The Brand Protection Conditions are the rules sellers must follow to sell products of specific brands on Allegro. If they do not — we will remove their offers. It will improve the competitiveness of our platform and may encourage more buyers to select your offers.
- We care about the buyers' trust and satisfaction. Thanks to the Brand Protection Conditions, we will reduce the number of offers with non-genuine products. It can strengthen the customers' positive shopping experience and encourage them to buy on Allegro again — and it may be at your store.
- We increase the brand protection level. Thanks to the Brand Protection Conditions, we can encourage brand owners to sell their products on Allegro. It is a great chance for them — they can develop and increase the number of potential customers. You, on the other hand, get a chance to add branded products to your assortment.
