How you can add a fee for plastic single-use packaging to your offers

If you sell plastic single-use packaging, for example, food and beverage containers — you are obliged to charge an environmental fee from end consumers. The end consumer is the one who buys the packaging alone or products packed in it for their own purposes and does not resell them.
The legal basis
The Act of April 14, 2023, on changes of the act on the obligations of entrepreneurs concerning the managing of specific waste and the product fee — available in Polish.
The Regulation of December 7, 2023, of the Ministry of Climate and Environment on the fees for plastic single-use packaging — available in Polish.
Check how you can add the environmental fee to your offers
You can sell your products both to the buyers who are end consumers and those who are not. That is why, you can list two offers with the same product:
- For business customers — without the environmental fee. In the offer description, provide the information that the price does not include such a fee. If buyers order products for their own purposes (being end consumers), they should place an order in the offer for individual customers and ask for an invoice. You can add that offer's number.
- For individual customers — with the environmental fee added to the price. In the offer description, provide the information that the price includes the fee. You can add the offer number for the business customers who want to purchase products to resell them. Only buyers with business accounts can go to the offer for business customers.
What information you can provide in the offer description
In the offer description, you can provide the information on the environmental fee and another offer's number — it complies with our Terms & Conditions. However, if you provide a link to another offer, you violate our rules, and we will remove such an offer.
Under our Terms & Conditions and the price list, we will charge the sales commission from the price that includes the environmental fee.

Yes, when the buyer requests to return the product, and you accept it — you have to refund them the entire order price, with the environmental fee. The fees refunded this way are not included in the sum for a given year which, as per the Act, you have to pay to your voivodeship Marshal Office's bank account until March 15 of the following year.

Buyers can request product returns within 14 days and have to send the products back within the next 14 days. By March 15, you will have learned the final statuses of all the orders from the previous year and found out whether you need to transfer the fee for a given order.
Example: The buyer placed an order on December 31 and decided to return the product on the last possible day — January 14 of the following year. They also returned the product on the last possible day — January 28. That means, until March 15, you will know whether you need to transfer the fee for a given order.
We created Allegro Lokalnie for individual buyers. Such buyers are, in principle, end consumers — they buy plastic packaging or products packed in it for their own purposes.
The final decision on how to treat such customers depends on you. You must pay the environmental fee if you sell products to which such a fee has to be added according to the rules.
Within One Fulfillment by Allegro, you can list one offer for a given product. For individual customers who, in principle, are end consumers — list the offer with the environmental fee added. For business customers — list the offer you will link to the product whose wholesale number of packages is treated as one set. If there is no such product in the Catalog, you can create it.
- Beverage containers (including lids and caps).
- Containers (including boxes with and without lids) for food that is:
- intended for immediate consumption, either on the premises or as a takeaway
- consumed directly from the container
- is ready to be consumed without further preparation (cooking, heating up) — including the containers for fast food or other meals ready for immediate consumption. The beverage containers, plates, packages, and wrappers containing food are an exception.
