What regulations regarding waste and packaging apply in Slovakia

When you ship your orders to other European Union countries, make sure you do it legally. Pay particular attention to waste and packaging regulations — including those that apply in the country to which you are shipping. In this case — Slovakia.
If you sell products subject to the extended producer responsibility (EPR) to Slovakia, you should:
- enter into relevant registers
- comply with the recycling regulations
- label your products properly.
What products are subject to the extended producer responsibility in Slovakia
In Slovakia, the rules concerning the extended producer responsibility are regulated by the Zákon zo 17. marca 2015 o odpadoch a o zmene a doplnení niektorých zákonov — the act also known as suo.
The act mentions the following product categories:
- packaging (§ 52 suo)
- non-packaged products (§ 73 suo)
- electrical and electronic equipment (§ 32 suo)
- batteries and accumulators (§ 42 suo)
- vehicles (§ 60 suo).
Glossary — terms you should know
The entity that places the packaging on the market — a person or a company that sells products in the packaging in Slovakia — even if they do not run a business activity in that country.
Packaging — a product that allows proper transport, delivery, protection, and display of goods. It can be made of any material. It does not matter whether it is only used for transport and will be removed before the sale or the product will be sold in it.
Placing the packaging on the market — the moment when the packaging (itself or with the product) enters Slovakia for the first time, for example, arrives from another country. It does not matter whether customers will use it on their own or resell it.
Packaging manufacturer — a natural person that:
- uses the packaging to pack goods and places them on the market under their trademark
- is a person for whom the goods are packed and placed on the market under their trademark
- places the packaged goods on the market in a way different from the ones described above or transports such goods or orders their transport abroad Slovakia and distributes or places them on another country's market
- as a distributor, hands the packaging over to the end user for instant packing of goods, paid or free of charge
- as a distributor, uses the packaging to wrap the distributed goods or their parts or to fill it with such goods
- places the packaging on the market — that does not apply to a person who delivers the unused empty packaging to the people mentioned above.
Check your most important formal obligations
As a Polish seller that introduces their products onto the Slovak market:
- Check whether the selling of selected products is allowed in Slovakia. Remember that you have to comply with Appendix No. 1 of Allegro Terms & Conditions. You will find there the information on goods prohibited and restricted on Allegro.
- Make sure you hold all the intellectual property rights necessary to introduce the product in Slovakia (trademarks, patents, copyright).
- If you sell products of animal or plant origin, electronics, dietary supplements, or pyrotechnic products, make sure to check the policy of selling products to Slovakia. Those are the examples of product categories that require special attention and are subject to additional regulations.
- Make sure you have entered the necessary registers. Pay particular attention to waste and packaging regulations.
What the most important seller's obligations concerning waste and packaging are
- According to the act, before you place products on the Slovak market, you need to register with the Slovak Ministry of the Environment. If you do not have a registered office in Slovakia, the most convenient way to fulfill this obligation is through a company with a special permit to collect packaging waste. Check the list of approved manufacturer responsibility organizations.
- Enable the possibility to return packaging and explain to customers how and where they can do so.
- Declare how much packaging you will place on the Slovak market.
- If you mark what they are made of on the packaging, apply markings compliant with the UE requirements.
- Make sure you recycle packaging.
If the local authorities ask you to provide proof that you meet those obligations — you have to do it.
What obligations you need to meet
- Register with the Slovak Ministry of the Environment.
- Secure the collection, processing, and recycling of devices and electronic waste. This means your customer may return the used equipment stationary, by courier, or by an authorized third-party company — and you must provide them with the opportunity to do so.
- Label the products properly — for example, with the crossed-out bin symbol or the name and address of the manufacturer.
- Inform about product components and their recycling, as well as about the absence of hazardous substances.
- Prepare the documents you will add to the product in Slovak — for example, user manuals, product cards, labels.
What documents you need to have
When you place products from the Electronics category on the Slovak market, make sure to:
- label them properly — include the name/logo, address of the manufacturer and importer, batch, and serial number
- provide the CE marking that informs about the absence of noxious, hazardous, or risky substances
- place the crossed-out bin symbol on the equipment, packaging, or documents attached to it — it indicates that a given product cannot be disposed of together with other waste
- provide technical documentation that specifies product parameters and features
- attach a leaflet informing that the device is manufactured in a way that makes it easy to disassemble and reuse (this is the manufacturer's responsibility)
- attach the declaration of conformity of technical documentation with product properties.
If you do not have an official registered office or fixed establishment in Slovakia, you are obliged to authorize an external entity that:
- will represent you
- will guarantee that you meet the above obligations.

What obligations you need to meet
- Register with the Slovak Ministry of the Environment.
- Secure the collection, processing, and recycling of used batteries and accumulators. This means your customer may return the used equipment stationary, by courier, or by an authorized third-party company — and you must provide them with the opportunity to do so.
- Inform about the possibility of having the deposit fee reimbursed — including the amount of the deposit fee.
- Label the products properly — for example, with the crossed-out bin symbol or the name and address of the manufacturer.
What documents you need to have
When you place products from the Batteries and accumulators category on the Slovak market, make sure to:
- label them properly — include the name/logo, address of the manufacturer and importer, batch, and serial number
- provide the CE marking that informs about the absence of noxious, hazardous, or risky substances
- place the crossed-out bin symbol on the equipment, packaging, or documents attached to it — it indicates that a given product cannot be disposed of together with other waste
- provide technical documentation that specifies product parameters and features
- attach a leaflet informing that the device is manufactured in a way that makes it easy to disassemble and reuse (this is the manufacturer's responsibility)
- attach the declaration of conformity confirming technical documentation with product properties.
If you do not have an official registered office or fixed establishment in Slovakia, you are obliged to authorize an external entity that:
- will represent you
- will guarantee that you meet the above obligations.

How to settle the packaging you introduce to Slovakia
If you place packaging on the Slovak market, you must comply with the obligations resulting from the extended producer responsibility. The Slovak law is stricter in this respect than, for example, the Czech law.
In Slovakia, the issues mentioned above are regulated by Zákon zo 17. marca 2015 o odpadoch a o zmene a doplnení niektorých zákonov (suo). According to the act, before placing products on the Slovak market, you must register at the Slovak Ministry of the Environment. Designate an authorized representative if you do not have a registered office in Slovakia. The authorized representative is a person who, based on a written power of attorney, can, for example, conclude an agreement with the producer responsibility organization and order the registration in the Slovak ISOH register — the counterpart of the Polish BDO (Waste Database Number) — on your behalf.
That way, you will meet the environmental obligations concerning, for example, the collection, transport, management, and recycling of waste. Technically, those obligations are imposed on the entrepreneur who places the products on the market — in practice, they are fulfilled collectively, by specially appointed entities.
How to designate an authorized representative
You can contact the waste management organizations directly. Each organization has recommended authorized representatives they cooperate with — they can provide you with the representatives' contact details.
Once you conclude an agreement with the waste managing organization, your obligations will be:
- to mark the packaging in accordance with the EU standards
- to keep an accurate record of the packaging and products you place on the market.
How to meet the obligation to recycle products
Products that are subject to recycling fees in Slovakia include:
- electrical equipment
- batteries
- accumulators
- packaging
- unpackaged products.
