What legal obligations you need to meet before you sell certain products in Hungary
Before you place certain product categories on the Hungarian market, you need to meet specific legal obligations.
This applies to selling the following products in Hungary:
- dietary supplements
- medical devices
- blank audiovisual recording media and reprographic equipment.
You can sell to Hungary, among others:
- first aid equipment, under separate regulations, in uniform and unopened packaging
- dressing materials
- blood pressure monitors
- mass-produced optical products, except contact lenses
- batch produced flat orthopedic insoles
- urine suction and defecation devices.
On allegro.hu, you are not allowed to offer medical devices subject to restrictions set forth in Decree 7/2004 on professional requirements for distributing, repairing, and renting medical equipment.
What you need to do to sell dietary supplements on the Hungarian market
- Notify the National Center for Public Health and Pharmacy (NNGYK) that you plan to sell a dietary supplement in Hungary.
- If you have already submitted a notification in another EEA (European Economic Area) member state, provide the name of the authority you notified.
- All dietary supplements you will be selling in Hungary must meet the requirements of Directive 2002/46/EU on food supplements.
Rules for labeling, presenting, and advertising dietary supplements
- The product labels, presentations, offer descriptions, and advertisements of the dietary supplement must not inform or suggest that the product can prevent or cure a disease.
- The product labels, presentations, offer descriptions, and advertisements of the dietary supplement must not inform or suggest that a balanced and varied diet does not contain the necessary nutrients.
Legal obligations you need to meet to place medical devices on the Hungarian market
- Register the product you want to sell in Hungary with the National Center for Public Health and Pharmacy (NNGYK).
- Make sure that the medical device has a CE mark and a declaration of conformity.
- Provide user manuals in Hungarian.
- In the case of imported devices — the importer must comply with the requirements in the European Medical Device Regulation. In some cases, the manufacturer must assign a UDI (Unique Device Identification) to the product.
Legal obligations you need to meet to place blank audiovisual recording media and reprographic equipment on the Hungarian market
- Blank audiovisual recording media and reprographic equipment sold in Hungary are subject to a private copying fee.
- You need to notify the Hungarian collective copyright management organization about the type and number of products you import.
