How you can protect intellectual property rights

Do not list counterfeit products
The sale of counterfeit products on Allegro is prohibited. If you offer counterfeit products, you infringe on the registered trademark right ― which may lead to legal consequences. By doing so, you come across as an unreliable seller. Do not list products that infringe on the industrial design right. The external form of a product (its design) is also subject to protection. That means, the designs of popular items ― from furniture to electric toothbrush tips ― may be legally protected. Copying the product design ― even without the manufacturer's logo ― may infringe on its rights. Before you list an offer, make sure that the product you want to sell does not infringe on the industrial design right. The protection that stems from the industrial design right is a complex issue. If you have any doubts, seek counsel from a law firm that specializes in the intellectual property rights.
Avoid content that may be misleading
Make sure the offer description is accurate and does not mislead buyers. Describe the product you sell unambiguously and provide necessary details. Incorrect or ambiguous information in the offer description mislead buyers. That may also infringe on the brand owner's rights. That may also happen if you include a popular brand name in the description for comparison reasons. By doing so, you may violate the law by the unauthorized use of a registered trademark.

How to protect your intellectual property
To protect your intellectual property effectively, make sure to correctly safeguard your rights.
Resources on the criteria you have to meet and ways to safeguard your rights to industrial designs or a trademark are available on widely accessible websites of the government (gov.pl), the Patent Office, and the European Union Intellectual Property Office.
What if someone violates your rights
If you think that someone has violated your intellectual property rights, and you have documents that confirm your ownership of those rights, report it to us.
Note: We can review your report only if you provide us with the necessary documents.
How to report a violation of your rights
Before you report a violation of your rights to us, make sure to prepare:
- documents confirming your exclusive rights or power of attorney to represent the holder of rights in matters of intellectual property protection
- documents confirming the registration of trademarks and industrial designs, of which a violation you want to report
- information on the violation type and legal basis of your request to remove the offers
- numbers of offers in which you have noticed a violation (or links to those offers).
Then, report the violation to us. There are 2 options.
Through a report form
- Click [report a violation] at the bottom of the offer page.
- In the form, select Report illegal item/content/service as the topic and Non-genuine product as the reason.
- Justify your report. Remember that we will later ask you for documentation confirming your exclusive rights ownership (e.g., trademark/industrial design registration confirmation).
Via email
- Go to the Rights Protection Cooperation Program page and read the information that we have prepared for you.
- Send your report to us at program.wop@allegro.com. Include "Right violation report" in the title.
- Attach documents that confirm your intellectual property rights. We will contact you after we verify your report.
