The EU’s ESPR (Ecodesign for Sustainable Products Regulation) comes into force on July 19, 2026. Learn more about the regulations that put a ban on the destruction of unsold clothing and footwear.
Who will be affected by the ban
- From July 19, 2026, the ban will apply to large enterprises.
- From July 19, 2030, the ban will apply to medium-sized enterprises. Micro- and small enterprises are completely exempt from this ban.

How the destruction of products is defined
You destroy products not only when you physically damage them or throw them into a landfill. According to EU regulations, you also destroy products when you:
- recycle them
- subject them to energy recovery
- neutralize them.
Exceptions from the ban
You can destroy unsold clothing or footwear if the product:
- poses a threat to health, hygiene, and safety, meaning it is a dangerous product
- does not meet legal requirements (EU or national) for reasons other than safety, and its destruction is legally mandated
- infringes on intellectual property rights, for example, it is a counterfeit
- is subject to intellectual property rights due to an expired license or agreement that restricts the possibility of its further sale
- is not suitable for refurbishment and reuse — protected logos or tags cannot be permanently removed from it, or it violates accepted social norms
- has been damaged, broken, or contaminated, for example by the buyer, in transit, or in the warehouse, and its repair is neither possible nor cost-effective
- has irreversible manufacturing or design defects
- has been offered as a donation (directly to three charitable organizations or for a minimum of 8 weeks on the seller's website) but did not find a recipient.
If you use exceptions, keep the documents that confirm them — for example, quality control results or donation offers — for 5 years. You will need them during an official inspection.
